Laki rauhoitettujen eläinten aiheuttamien vahinkojen ennalta ehkäisemisestä ja korvaamisesta annetun lain 3 ja 4 §:n muuttamisesta
Eduskunnan päätöksen mukaisesti muutetaan rauhoitettujen eläinten aiheuttamien vahinkojen ennalta ehkäisemisestä ja korvaamisesta annetun lain (15/2022) 3 §:n 2 ja 4 momentti sekä 4 §:n 1 kohta seuraavasti:
3 §Euroopan unionin valtiontukilainsäädännön soveltaminen
Avustus ja korvaus myönnetään komission tiedonannossa maa- ja metsätalousalan ja maaseutualueiden valtiontukea koskevista suuntaviivoista (2022/C 485/01) tarkoitettuna, suuntaviivojen jaksojen 1.1.1.1. tai 1.2.1.5. mukaisena valtiontukena. Sääksen pesintään perustuva tuki myönnetään Euroopan unionin toiminnasta tehdyn sopimuksen 107 ja 108 artiklan soveltamisesta vähämerkityksiseen tukeen kalastus- ja vesiviljelyalalla annetussa komission asetuksessa (EU) N:o 717/2014 tarkoitettuna vähämerkityksisenä tukena.
Tarkempia säännöksiä avustuksen, korvauksen tai sääksen pesintään perustuvan tuen myöntämisestä, myöntämisen edellytyksistä, maksamisesta, käytöstä ja elinkeino-, liikenne- ja ympäristökeskuksen sekä avustuksen saajan velvollisuuksista voidaan antaa valtioneuvoston asetuksella noudattaen, mitä 2 momentissa mainituissa suuntaviivoissa määrätään ja 2 momentissa mainitussa asetuksessa säädetään.
4 §Määritelmät
Tässä laissa tarkoitetaan:
1) rauhoitetulla eläimellä luonnonsuojelulain (9/2023) nojalla rauhoitettua, luonnonvaraisena esiintyvää lintua ja nisäkästä;

Tämä laki tulee voimaan päivänä kuuta 20 .
