1.Laki omaishoidon tuesta annetun lain 5 §:n muuttamisesta
Eduskunnan päätöksen mukaisesti muutetaan omaishoidon tuesta annetun lain (937/2005) 5 § seuraavasti:
5 §Hoitopalkkio
Palkkion taso määräytyy hoidon sitovuuden ja vaativuuden mukaan. Hoitopalkkio on vähintään 530 euroa kuukaudessa.
Jos omaishoitaja on hoidollisesti raskaan siirtymävaiheen aikana lyhytaikaisesti estynyt tekemästä omaa tai toisen työtä, palkkio on vähintään 968 euroa kuukaudessa edellyttäen, että hoitajalla ei ole tältä ajalta:
1) vähäistä suurempia työtuloja;
2) oikeutta sairausvakuutuslain (1224/ 2004) 10 luvun mukaiseen erityishoitorahaan.
Hoitopalkkio voidaan sopia säädettyä määrää pienemmäksi, jos:
1) hoidon sitovuus on vähäisempää kuin mitä 4 §:n 1 momentissa edellytetään ja hoidon ja huolenpidon tarve on vähäistä; taikka
2) siihen on hoitajan esittämä erityinen syy.
§
Tämä laki tulee voimaan päivänä kuuta 20 .
2.Laki perhehoitolain 12 §:n muuttamisesta
Eduskunnan päätöksen mukaisesti lisätään perhehoitolain (263/2015) 12 §:ään, sellaisena kuin se on osaksi laissa 606/2022, uusi 2–4 momentti, jolloin nykyinen 2 momentti siirtyy 5 momentiksi, seuraavasti:
12 §Toimeksiantosopimuksen irtisanominen ja purkaminen
Jos toimeksiantosopimus, joka koskee perhehoitajan kotona annettavaa ympärivuorokautista tai osavuorokautista pitkäaikaista perhehoitoa, päättyy ennakoimattomasti perhehoitajasta riippumattomasta syystä, on perhehoitajalla oikeus saada 1 momentissa tarkoitetulta irtisanomisajalta maksettavan palkkion lisäksi yhden kuukauden hoitopalkkion määrää vastaava korvaus. Mitä edellä säädetään, ei koske perhehoitoa, joka on järjestetty omaishoidon tuesta annetun lain (937/2005) 4 §:n 3 momentin nojalla.
Oikeutta 2 momentissa tarkoitettuun korvaukseen ei ole, jos perhehoitajan kotiin olisi sijoitettavissa tai sijoitetaan irtisanomisaikana uusi hoidettava.
Edellä 2 momentissa tarkoitetun korvauksen maksaa se hyvinvointialue, jonka kanssa perhehoitajan toimeksiantosopimus päättyy 2 momentissa tarkoitetulla tavalla.

Tämä laki tulee voimaan päivänä kuuta 20 .
