Laki kasvinterveyden suojelemisesta annetun lain muuttamisesta
Eduskunnan päätöksen mukaisesti lisätään kasvinterveyden suojelemisesta annettuun lakiin (702/2003) uusi 31 a § seuraavasti:
7 luku – Vahingonkorvaukset
31 a §Eräät Euroopan unionin lainsäädännöstä johtuvat korvauksensaajia koskevat vaatimukset
Sen lisäksi, mitä 30, 30 a ja 31 §:ssä säädetään, tässä laissa tarkoitettuihin kustannuksiin ja korvauksiin sovelletaan maatalousalalla toimivien yritysten osalta tiettyjen maa- ja metsätalousalan ja maaseutualueiden tukimuotojen toteamisesta sisämarkkinoilla soveltuviksi Euroopan unionin toiminnasta tehdyn sopimuksen 107 ja 108 artiklan mukaisesti annetun komission asetuksen (EU) N:o 702/2014 (EUVL L 193, 1.7.2014, s. 1) I lukua ja 26 ja 28 artiklaa sekä metsätalousalalla toimivien yritysten osalta Euroopan unionin maa- ja metsätalousalan ja maaseutualueiden valtiontuesta vuosina 2014—2020 annettujen Euroopan unionin suuntaviivojen (2015/C 390/05, EUVL C 390, 24.11.2015, s. 4) kohtia 75, 594 ja 594 a.
Edellä 1 momentissa mainitun komission asetuksen mukainen tuki voidaan maksaa vain asetuksen 2 artiklan 2 kohdassa tarkoitetuille mikroyrityksille sekä pienille ja keskisuurille yrityksille.
Korvauksia ei makseta 1 momentissa mainituissa komission asetuksessa ja unionin suuntaviivoissa tarkoitetulle vaikeuksissa olevalle yritykselle, ellei vaikeuksiin joutuminen johdu kasvintuhoojasta. Korvausta ei myöskään makseta, jos korvauksen hakija ei ole noudattanut komission aiempaan päätökseen perustuvaa eräiden valtion tukea koskevien Euroopan unionin säännösten soveltamisesta annetun lain (300/2001) 1 §:ssä tarkoitettua tuen takaisinperintäpäätöstä.

Tämä laki tulee voimaan päivänä kuuta 20 .
