Laki metsätuhojen torjunnasta annetun lain 21 §:n muuttamisesta
Eduskunnan päätöksen mukaisesti muutetaan metsätuhojen torjunnasta annetun lain (1087/2013) 21 §:n 1 momentti, sellaisena kuin se on laissa 21/2023, seuraavasti:
21 §Valtion vahingonkorvausvastuu
Luonnonsuojelulain (9/2023) 43 §:ssä tarkoitetulta luonnonsuojelualueelta, 48 §:ssä tarkoitetulta määräaikaisesti rauhoitetulta alueelta, 64 §:ssä tarkoitetulta suojellun luontotyypin rajatulta esiintymisalueelta, 65 §:ssä tarkoitetulta tiukasti suojellun luontotyypin esiintymisalueelta, 77 §:ssä tarkoitetulta erityisesti suojeltavan eliölajin esiintymispaikalta, 81 §:ssä tarkoitetulta uutena tavatun eliölajin suojelemiseksi rajatulta esiintymispaikalta, 85 §:ssä tarkoitetulta erityisesti suojeltavan eliölajin avustetun leviämisen paikalta, 95 §:ssä tarkoitetun rauhoitetun luonnonmuistomerkin paikalta, 104 §:ssä tarkoitetulta hyvitysalueelta, 124 §:ssä tarkoitetulta toimenpidekieltoon asetetulta alueelta, valtiolle luonnonsuojelutarkoitukseen hankitulta alueelta sekä muulta sellaiselta valtion omistamalta alueelta, jota hoidetaan Metsähallituksen tai valtion maata hallinnoivan viranomaisen suojelupäätöksen mukaisesti, todennäköisesti levinneiden metsätuhojen aiheuttamat vahingot korvataan valtion varoista siten kuin jäljempänä säädetään. Syy-yhteyden todennäköisyyttä arvioitaessa on kiinnitettävä huomiota muun ohella vahingon laatuun ja vahingon mahdollisiin muihin syihin.

Tämä laki tulee voimaan päivänä kuuta 20 .
Tätä lakia sovelletaan metsätuhoihin, jotka ovat aiheutuneet 1 päivänä kesäkuuta 2023 tai sen jälkeen.
