Laki kansaneläkelain väliaikaisesta muuttamisesta
Eduskunnan päätöksen mukaisesti muutetaan väliaikaisesti kansaneläkelain (568/2007) 74 §:n 2 momentti, sellaisena kuin se on laissa 1223/2009, ja lisätään lakiin väliaikaisesti uusi 65 a § seuraavasti:
65 a §Etuuden maksaminen ja keskeyttäminen Yhdistyneen kuningaskunnan erottua Euroopan unionista
Sen estämättä mitä 65 §:ssä säädetään, jos etuudensaaja asui Ison-Britannian ja Pohjois-Irlannin yhdistyneessä kuningaskunnassa, kun kuningaskunnan ero Euroopan unionin jäsenyydestä tuli voimaan, etuuden maksaminen keskeytetään vuoden kuluttua eroa seuraavan kuukauden alusta, jollei etuutta tule muusta syystä keskeyttää tai lakkauttaa tätä aiemmin.
74 §Etuuden lakkaaminen
Eläke lakkaa ilman eri päätöstä, jos 65 §:n 1 momentin, 65 a §:n tai 73 §:n 3 momentin 1 tai 2 kohdan perusteella keskeytettyä eläkettä ei ole kahden vuoden kuluessa keskeyttämisestä lukien vaadittu maksettavaksi.
§
Tämä laki tulee voimaan päivänä kuuta 20 ja se on voimassa 31 päivään joulukuuta 2022.
Lakia sovelletaan siitä päivästä, jona Ison-Britannian ja Pohjois-Irlannin yhdistyneen kuningaskunnan ero Euroopan unionin jäsenyydestä tulee voimaan, jos kuningaskunta ei ole ratifioinut Euroopan unionin kanssa tekemäänsä sopimusta erosta.
Tämän lain voimaan tullessa maksussa olevan 65 a §:ssä tarkoitetun eläkkeen maksamista jatketaan ilman hakemusta.
