What is proposed
The Ministry of Justice's power to grant a special permit for a person under 18 to marry will be removed from the Marriage Act. In addition, the provision in the Act on Child Custody and Right of Access stating that custody of a minor ends upon marriage will be repealed.
What it means
The change affects minors planning to marry, as special permits can no longer be granted on grounds such as religious conviction or pregnancy. In recent years, the Ministry of Justice has processed 10–30 special permit applications each year, with the vast majority of applicants being 17-year-old girls. Applications submitted before the act enters into force will be processed to completion under the old act, and special permits that have already been granted will remain valid.
How Parliament voted
The act ultimately passed without a vote: no MP proposed rejecting it in the final reading. The only vote concerned a detail of the act.

Key points of the debate
Parliament was broadly unanimous on abolishing the special permit procedure for underage marriage and establishing an absolute age limit of 18 years. All parliamentary groups considered the change important for safeguarding the rights of children, especially girls, and for sending a clear international message. The debate mainly raised hopes that legislation would also be enacted in the future to criminalise forced marriages and annul child marriages.
- Should the bill have made it possible to annul marriages entered into as a minor instead of requiring a divorce?
- Should forced marriages be criminalised under separate legislation?
- National Coalition PartyIn favour
The group supported abolishing special permits and considered it important that marriage be restricted solely to adults in the best interests of the child and to set an international example.
The group supported the bill and stressed that, as societal values change, marriage clearly belongs to adult life without cultural or religious exceptions.
— Hanna-Leena Mattila - Social DemocratsIn favour
The group considered abolishing special permits an excellent and consistent baseline solution, but regarded swift further examination of the possibility of annulling marriages as important.
— Ilmari Nurminen - GreensIn favour
The group warmly supported the bill to strengthen girls' rights and considered the criminalisation and annulment of forced marriages an important next step.
”Vihreät kannattavat lämpimästi tätä hallituksen esitystä. Omassa poliittisessa ohjelmassamme on kirjattuna toive ja tavoite kriminalisoida kaikki lapsiavioliitot.”
— Hanna Halmeenpää - Left AllianceIn favour
The group strongly supported the act because a minor is not ready for such a significant legal contract and child marriages jeopardise the rights of girls in particular.
— Hanna Sarkkinen - Swedish People's PartyIn favour with reservations
The group supported banning underage marriages, but criticised the proposal for falling short because it does not allow the annulment of a marriage entered into as a minor and instead requires a divorce.
— Eva Biaudet - Christian DemocratsIn favour
The group considered the proposal good and justified to protect children, although it also drew attention to cohabitation and marriage practices in other cultures.
— Sari Tanus
