Laki arvonlisäverolain muuttamisesta
Eduskunnan päätöksen mukaisesti muutetaan arvonlisäverolain (1501/1993) 79 g §, 79 j §:n 2 momentti, 85 a §:n 1 momentin 3 ja 4 kohta ja 115 §:n 2 momentti, sellaisina kuin ne ovat, 79 g § laissa 1202/2011, 79 j §:n 2 momentti ja 115 §:n 2 momentti laissa 1071/2002 ja 85 a §:n 1 momentin 3 ja 4 kohta laissa 345/2019, sekä lisätään 69 d §:ään, sellaisena kuin se on laissa 886/2009, uusi 2 ja 4 momentti, jolloin nykyinen 2 momentti siirtyy 3 momentiksi ja 85 a §:ään, sellaisena kuin se on laeissa 345/2019 ja 623/2021, uusi 4 momentti seuraavasti:
69 d §
Edellä 1 momentissa säädettyä ei sovelleta mainitussa momentissa tarkoitettuihin elinkeinonharjoittajalle luovutettaviin palveluihin, jos osallistuminen tilaisuuteen on virtuaalista.
Jos 3 momentissa tarkoitetut palvelut ja liitännäispalvelut liittyvät toimintaan, joka lähetetään suoratoistona tai asetetaan muutoin virtuaalisesti saataville, ne on myyty Suomessa, jos ostaja on sijoittautunut tänne tai ostajan kotipaikka tai vakinainen asuinpaikka on täällä.
79 g §
Jollei asianomaisiin verovelvolliselle jälleenmyyjälle luovutettuihin tai tämän maahantuomiin taide-, keräily- ja antiikkiesineisiin ole sovellettu alennettua verokantaa, verovelvollisella jälleenmyyjällä on oikeus valita voittomarginaalijärjestelmän soveltaminen seuraavien liiketoimien osalta:
1) niiden taide-, keräily- tai antiikkiesineiden luovutukset, jotka verovelvollinen jälleenmyyjä itse on maahantuonut;
2) tekijän tai tämän oikeudenomistajien verovelvolliselle jälleenmyyjälle luovuttamien taide-esineiden luovutukset;
3) muun verovelvollisen kuin verovelvollisen jälleenmyyjän verovelvolliselle jälleenmyyjälle luovuttamien taide-esineiden luovutukset.
79 j §
Verovelvollisen jälleenmyyjän itse maahantuoman keräily- tai antiikkiesineen 1 momentissa tarkoitettuna ostohintana pidetään 9 luvussa tarkoitettua veron perustetta lisättynä veron osuudella.
85 a §
Seuraavien palvelujen myynnistä sekä seuraavien tavaroiden myynnistä, yhteisöhankinnasta, siirrosta varastointimenettelystä ja maahantuonnista suoritettava vero on 10 prosenttia veron perusteesta:
3) pääsy urheilutapahtumiin tai kyseisten tapahtumien suoratoistoon tai molempiin; urheilutilojen käyttö ja urheilu- tai liikuntatuntien tarjoaminen, myös suoratoistona;
4) pääsy näytöksiin, teattereihin, sirkuksiin, messuille, huvipuistoihin, konsertteihin, museoihin, eläintarhoihin, elokuvateattereihin, näyttelyihin ja vastaaviin kulttuuritapahtumiin ja -tiloihin tai pääsy kyseisten tapahtumien tai vierailujen suoratoistoon tai molempiin;
Edellä 1 momentin 9 kohdan nojalla alennettua verokantaa ei sovelleta sellaisten taide-esineiden luovutuksiin, joihin sovelletaan 79 a §:ssä tarkoitettua menettelyä.
115 §
Verovelvollinen jälleenmyyjä ei saa vähentää itse maahantuomastaan keräily- tai antiikkiesineestä suoritettavaa veroa, jos hän soveltaa tavaran myyntiin 79 a §:ssä tarkoitettua menettelyä.
§
Tämä laki tulee voimaan päivänä kuuta 20 .
Tämän lain 69 d §:n 2 ja 4 momenttia sovelletaan palveluun, joka on suoritettu tämän lain tultua voimaan.
Tämän lain 79 g ja 79 j §:ää, 85 a §:n 4 momenttia ja 115 §:ää sovelletaan niihin tavaroihin, jotka on toimitettu tai luovutettu tullivalvonnasta verovelvolliselle jälleenmyyjälle tämän lain tultua voimaan.
