Laki Euroopan unionin lainvalvontayhteistyövirastosta
Eduskunnan päätöksen mukaisesti säädetään:
1 §Soveltamisala
Tässä laissa annetaan Euroopan unionin lainvalvontayhteistyövirastosta (Europol) sekä neuvoston päätösten 2009/371/YOS, 2009/934/YOS, 2009/935/YOS, 2009/936/YOS ja 2009/968/YOS korvaamisesta ja kumoamisesta annettua Euroopan parlamentin ja neuvoston asetusta (EU) 2016/794, jäljempänä Europol-asetus , täydentävät säännökset.
2 §Kansallinen yksikkö
Keskusrikospoliisi on Europol-asetuksen 7 artiklassa tarkoitettu kansallinen yksikkö.
3 §Toimivaltaisten viranomaisten ja Europolin väliset yhteydet
Europol-asetuksen 2 artiklan a kohdassa tarkoitetuille Suomen toimivaltaisille viranomaisille sallitaan suorat yhteydet Europolin kanssa Europol-asetuksen 7 artiklan 5 kohdan mukaisesti.
Edellä 1 momentissa tarkoitetuilla toimivaltaisilla viranomaisilla on pääsy kaikkiin tietoihin, jotka on toimitettu Europolille Europol-asetuksen 18 artiklan 2 kohdan a ja b alakohdassa säädettyjä tarkoituksia varten sekä mahdollisuus hakea näitä tietoja. Toimivaltaisilla viranomaisilla on epäsuora pääsy tietoihin, jotka on toimitettu Europolille Europol-asetuksen 18 artiklan 2 kohdan c alakohdassa säädettyä tarkoitusta varten.
Suorien yhteyksien käyttöehdoista päättää Poliisihallitus keskusrikospoliisin esityksestä.
4 §Rekisteröidyn tiedonsaantioikeus ja virheellisten tietojen korjaaminen tai poistaminen
Europol-asetuksen 36 artiklan 3 kohdassa sekä 37 artiklan 1 ja 2 kohdassa tarkoitettu pyyntö on esitettävä poliisilaitokselle.
5 §Kansallinen valvontaviranomainen
Tietosuojavaltuutettu on Europol-asetuksen 42 artiklan 1 kohdassa tarkoitettu kansallinen valvontaviranomainen.
6 §Voimaantulo
Tämä laki tulee voimaan 1 päivänä toukokuuta 2017.
Tällä lailla kumotaan Europolia koskevan päätöksen eräiden säännösten täytäntöönpanosta annettu laki (563/2011).
