Laki tuloverolain 46 ja 55 §:n muuttamisesta
Eduskunnan päätöksen mukaisesti muutetaan tuloverolain (1535/1992) 46 §:n 8 momentti sekä 55 §:n 2 ja 4 momentti, sellaisina kuin ne ovat, 46 §:n 8 momentti ja 55 §:n 2 momentti laissa 1085/2008 sekä 55 §:n 4 momentti laissa 896/2001, seuraavasti:
46 §Luovutusvoiton laskeminen
Metsän luovutusvoiton määrää laskettaessa luovutusvoittoon lisätään 55 §:n nojalla tehdyn metsävähennyksen määrä, kuitenkin enintään määrä, joka vastaa 75 prosenttia luovutettavan metsän hankintamenosta.
55 §Metsävähennys
Metsävähennyksen määrä on enintään 75 prosenttia verovelvollisen metsävähennykseen oikeuttavasta metsästä verovuonna saaman veronalaisen metsätalouden pääomatulon määrästä. Verovelvollisen verovuonna ja aikaisempina verovuosina tekemien metsävähennysten yhteismäärä vähennettynä määrällä, joka 46 §:n 8 momentin nojalla on lisätty metsän veronalaiseen luovutusvoittoon, ei saa ylittää 75 prosenttia verovelvollisen verovuoden lopussa omistamien metsävähennykseen oikeuttavien metsien yhteenlaskettujen hankintamenojen määrästä.
Metsävähennys tehdään verovelvollisen vaatimuksesta. Vaatimus tulee tehdä ennen verovuodelta toimitettavan verotuksen päättymistä ja sen yhteydessä tulee esittää selvitys vähennyksen edellytysten täyttymisestä. Verovuonna tehtävän metsävähennyksen on oltava vähintään 1 500 euroa.

Tämä laki tulee voimaan päivänä kuuta 20 .
Tätä lakia sovelletaan ensimmäisen kerran vuodelta 2026 toimitettavassa verotuksessa. Tämän lain 46 §:ää sovelletaan kuitenkin ensimmäisen kerran vasta vuodelta 2027 toimitettavassa verotuksessa.
