Laki EU-ympäristömerkistä annetun lain muuttamisesta
Eduskunnan päätöksen mukaisesti muutetaan EU-ympäristömerkistä annetun lain (832/2014) 2, 4 ja 11 § seuraavasti:
2 §Toimivaltainen elin
Ympäristömerkkiasetuksen 4 artiklassa tarkoitettu toimielin Suomessa on Ympäristömerkintä Suomi Oy.
Ympäristömerkkiasetuksen mukaisia tehtäviä Ympäristömerkintä Suomi Oy:ssä hoitaviin sovelletaan heidän hoitaessaan näitä tehtäviä rikosoikeudellista virkavastuuta koskevia säännöksiä. Vahingonkorvausvastuusta säädetään vahingonkorvauslaissa (412/1974).
4 §Tarkastus ja valvonta
Ympäristöministeriöllä on oikeus tarkastaa ja valvoa Ympäristömerkintä Suomi Oy:n toimintaa ympäristömerkinnän hallinnoijana.
11 §Muutoksenhaku
Ympäristömerkintä Suomi Oy:n maksun määräämistä koskevaan päätökseen saa vaatia oikaisua Ympäristömerkintä Suomi Oy:ltä siten kuin hallintolaissa (434/2003) säädetään.
Oikaisuvaatimukseen annettuun päätökseen sekä Ympäristömerkintä Suomi Oy:n ympäristömerkin myöntämistä koskevaan päätökseen saa hakea muutosta valittamalla hallinto-oikeuteen siten kuin hallintolainkäyttölaissa (586/1996) säädetään. Hallinto-oikeuden päätökseen saa hakea muutosta valittamalla vain, jos korkein hallinto-oikeus myöntää valitusluvan.
§
Tämä laki tulee voimaan päivänä kuuta 20.
