Laki varhaiskasvatuslain muuttamisesta
Eduskunnan päätöksen mukaisesti muutetaan varhaiskasvatuslain (540/2018) 68 §:n 2 momentti ja 72 §:n 1 momentti sekä lisätään 70 §:ään siitä lailla 1021/2019 kumotun 5 momentin tilalle uusi 5 momentti ja 72 §:ään uusi 4 momentti, jolloin nykyinen 4 ja 5 momentti siirtyvät 5 ja 6 momentiksi, seuraavasti:
68 §Tietojen tallentaminen tietovarantoon
Edellä 1 momentista poiketen kunta tai kuntayhtymä tallentaa itse tuottamiensa palveluiden lisäksi muiden 5 §:ssä tarkoitetulla tavalla järjestämässään varhaiskasvatuksessa olevien lasten osalta 70 §:n 3 momentin 1 ja 3—7 kohdassa ja 4 momentissa tarkoitetut tiedot. Yksityisen palveluntuottajan on tallennettava 4 momentin 1 ja 2 kohdassa tarkoitetut tiedot niiden lasten osalta, joiden varhaiskasvatusta ei ole järjestetty 5 §:ssä tarkoitetulla tavalla. Lisäksi kunta tai kuntayhtymä tallentaa 15 e §:n 2 momentin mukaisesti tekemistään hallintopäätöksistä 70 §:n 5 momentissa tarkoitetut tiedot.
70 §Varhaiskasvatusta koskevat tiedot
Lisäksi tietovarantoon on tallennettava 15 e §:ssä tarkoitettujen päätösten lukumäärät lapsen iän perusteella jaoteltuina. Tiedot tulee tallentaa kunnallisista ja yksityisistä palveluntuottajista erikseen.
72 §Tietovarannon tietojen säilytysaika
Edellä 70 §:n 1 momentissa tarkoitetut varhaiskasvatuksen järjestäjää ja tuottajaa koskevat tiedot säilytetään tietovarannossa, kunnes viisi vuotta on kulunut sen kalenterivuoden päättymisestä, jona varhaiskasvatuksen järjestäjän tai tuottajan toiminta lakkasi.
Edellä 70 §:n 5 momentissa tarkoitetut varhaiskasvatuksen tuen hallintopäätöksiä koskevat lukumäärätiedot säilytetään tietovarannossa, kunnes viisi vuotta on kulunut vuosittaisen tiedonkeruun päättymisestä.
