Clarifying consent for home sales

Act amending section 86 of the Marriage Act

Selling one's own home will no longer require the consent of a former spouse if more than ten years have passed since divorce or the death of the spouse. Clarifications will be made to the act so that this rule and its transitional period are applied correctly.

What is proposed

The Marriage Act and its transitional provision will be amended before entry into force so that the expiry of restrictions on the disposition of a home and household effects after a 10-year period clearly applies to divorce, annulment of marriage and the death of a spouse.

What it means

The amendment will increase legal certainty and clarify practice for divorced homeowners, estate agents and registry authorities from 1 June 2026. For marriages that ended before the act enters into force, exemption from consent will require, in addition to the 10 years, that at least five years have passed since the act entered into force.

Key points of the debate

The debate addressed a clarification to the Marriage Act and a transitional provision concerning the removal of the requirement for a former spouse's consent in home sales ten years after divorce. The proposal was completely unanimous, and speakers considered it necessary to rectify a flaw identified in the previously approved act before its entry into force.

  • The National Coalition Party (NCP) supports the bill because it clarifies legislation and rectifies a shortcoming in the previously approved act before its entry into force, safeguarding legal certainty.

Sen sijaan tämä esitys on tarpeellinen täsmennys, jolla varmistetaan lain tarkoituksen toteutuminen ja kansalaisten oikeusvarmuus.

  • Finns PartyIn favour

The Finns Party (Finns) supports the proposal, which rectifies a shortcoming left in the transitional provision of the previously approved act.

Tässä nyt siis täsmennetään sitä 2025 hyväksyttyä, mikä tulee voimaan kesäkuun 1. päivä.

Esityksessä ehdotetaan muutettavaksi avioliittolakia.
