Laki ympäristönsuojelulain 21 ja 209 §:n muuttamisesta
Eduskunnan päätöksen mukaisesti muutetaan ympäristönsuojelulain (527/2014) 21 §:n 4 momentti ja 209 §, sellaisena kuin niistä on 21 §:n 4 momentti laissa 423/2015, seuraavasti:
21 §Valtion viranomaiset
Suomen ympäristökeskus toimii otsonikerrosta heikentävistä aineista annetun Euroopan parlamentin ja neuvoston asetuksen (EY) N:o 1005/2009, jäljempänä otsoniasetus , sekä fluoratuista kasvihuonekaasuista ja asetuksen (EY) 842/2006 kumoamisesta annetun Euroopan parlamentin ja neuvoston asetuksen (EU) N:o 517/2014, jäljempänä F-kaasuasetus , mukaisena toimivaltaisena viranomaisena. Lisäksi Suomen ympäristökeskus ylläpitää ja kehittää parhaan käyttökelpoisen tekniikan tiedonvaihtoa, seuraa parhaan käyttökelpoisen tekniikan kehittymistä ja tiedottaa siitä.
209 §Mittausten ja tutkimusten laadunvarmistus
Tämän lain täytäntöönpanon edellyttämät mittaukset, testaukset, selvitykset ja tutkimukset on tehtävä pätevästi, luotettavasti ja tarkoituksenmukaisin menetelmin.
Ilmatieteen laitos huolehtii ilmanlaadusta ja sen parantamisesta annetun Euroopan parlamentin ja neuvoston direktiivin 2008/50/EY 3 artiklan ensimmäisen kohdan b alakohdan mukaisesta ilmanlaadun mittausjärjestelmien vaatimuksenmukaisuuden sekä I liitteen C osion mukaisesta mittaustulosten tarkastamisesta. Tarkastamisesta on laadittava vuosittain kirjallinen arvio, joka tulee toimittaa ympäristöministeriölle viimeistään 31 päivänä heinäkuuta.
Valtioneuvoston asetuksella voidaan antaa tarkempia säännöksiä:
1) näytteenotosta, mittaus-, laskenta- ja testausmenetelmistä, standardeista ja laskentamalleista, joita on käytettävä tämän lain ja sen nojalla annettujen säännösten soveltamisessa;
2) näytteenoton, mittausten, testausten, selvitysten ja tutkimusten luotettavuuden ja laadun varmistamisesta.
§
Tämä laki tulee voimaan päivänä kuuta 20 .
