Laki rakennuksen energiatodistuksesta annetun lain 3 §:n muuttamisesta
Eduskunnan päätöksen mukaisesti muutetaan rakennuksen energiatodistuksesta annetun lain (50/2013) 3 §:n 1 momentti seuraavasti:
3 §Velvollisuuksien kohteena olevat ja niistä vapautetut rakennukset
Tässä laissa säädetyt velvollisuudet hankkia energiatodistus ja käyttää sitä koskevat rakennusta, jossa käytetään energiaa rakennuksen tilojen tarkoituksenmukaisten sisäilmasto-olosuhteiden ylläpitämiseksi. Velvollisuudet eivät kuitenkaan koske:
1) rakennusta, jonka pinta-ala on enintään 50 neliömetriä;
2) loma-asumiseen tarkoitettua rakennusta, jota ei käytetä majoituselinkeinon harjoittamiseen;
3) väliaikaista rakennusta, jonka käyttöaika on enintään kaksi vuotta;
4) teollisuus- ja korjaamorakennusta;
5) muuhun kuin asuinkäyttöön tarkoitettua maatilarakennusta, jossa energiantarve on vähäinen tai jota käytetään alalla, jota koskee kansallinen alakohtainen energiatehokkuussopimus;
6) rakennusta, joka on suojeltu maankäyttö- ja rakennuslain (132/1999) mukaisella kaavalla, rakennusperinnön suojelemisesta annetun lain (498/2010) tai sitä edeltävien säännösten mukaisella päätöksellä taikka rakennusta, joka sijaitsee maailman kulttuuri- ja luonnonperinnön suojelemisesta tehdyn yleissopimuksen (SopS 19/1987) mukaisessa maailmanperintöluetteloon hyväksytyssä kohteessa tai on kohteena viranomaisten välisessä rakennuksen suojelua koskevassa sopimuksessa, edellyttäen, että rakennuksen luonne tai ulkonäkö muuttuisi vaatimusten vuoksi tavalla, jota ei voida hyväksyä;
7) kirkkoa tai muuta uskonnollisen yhteisön omistamaa rakennusta, jossa on vain kokoontumiseen tai hartauden harjoittamiseen taikka näitä palvelevaan toimintaan tarkoitettuja tiloja;
8) kasvihuonetta, väestönsuojaa tai muuta rakennusta, jonka käyttö tarkoitukseensa vaikeutuisi kohtuuttomasti, jos niihin sovellettaisiin rakennusten energiatehokkuutta koskevia säännöksiä ja määräyksiä; eikä
9) sellaista puolustushallinnon käytössä olevaa rakennusta, johon tai jonka käyttöön liittyy salassa pidettävää tietoa.
§
Tämä laki tulee voimaan päivänä kuuta 20 .
Lakia sovelletaan ennen lain voimaantuloa käyttöön otettuun rakennukseen tai rakennuksen tilaan kuitenkin vasta 1 päivästä tammikuuta 2017. Siihen saakka tällaisiin rakennuksiin tai rakennuksen tiloihin sovelletaan tämän lain voimaan tullessa voimassa olleita säännöksiä.
