What is proposed
A provision will be added to the tax treaty under which Finland will obtain the right to tax voluntary pensions and supplementary pensions paid from Finland to Switzerland. The agreement will incorporate international minimum standards combating base erosion and profit shifting, as well as a procedure for denying tax treaty benefits in cases of abuse. In addition, the tax treaty will include a binding arbitration procedure allowing tax disputes between the states to be resolved by an independent panel.
What it means
The change affects individuals resident in Switzerland who receive pensions based on voluntary pension schemes from Finland, whose tax burden may rise and reporting obligations increase. The reform is estimated to bring the state approximately 0 to 4 million euros in additional tax revenue annually. For corporate and individual taxpayers, the arbitration procedure offers a more effective means of resolving international double taxation issues if the states fail to reach agreement within three years.
