What is proposed
The tax treaty between Finland and Germany will be updated in line with the modern OECD Model Tax Convention. Among other changes, the reform extends the source state's right to tax pension income, eliminates withholding tax on cross-border royalties between the countries, and enhances the exchange of tax information between authorities.
What it means
The change affects companies operating between Finland and Germany, investors, and cross-border income earners between the countries, such as individuals resident in Germany who receive pensions from Finland. Finland's tax revenues are expected to increase somewhat, especially due to the extension of taxing rights on pensions. The treaty will enter into force 30 days after both countries have ratified it.
How Parliament voted
The bill passed without a vote – no MP proposed rejecting or amending it in plenary.

Key points of the debate
Parliament unanimously supported concluding a new income tax treaty with Germany to prevent double taxation and tax evasion. The debate broadened into general tax policy, with MPs debating whether the Government was acting vigorously enough against aggressive tax planning and the shadow economy. In addition, the need to examine the tax treatment of pensions paid from Sweden was raised.
- Are sufficient actions being taken domestically and at EU level to combat aggressive tax planning and tax evasion?
- Should a separate agreement be negotiated with Sweden on the taxation of Finns receiving pensions from there?
- National Coalition PartyIn favour
The group supports the agreement and sees international cooperation in the EU and the OECD improving the situation in combating the shadow economy and aggressive tax planning.
”kannustaminen on aina paikallaan, mutta pitää sanoa, että aivan viime vuosina sekä Euroopan unionin piirissä että OECD:n piirissä on otettu merkittäviä askeleita”
— Ben Zyskowicz - Finns PartyIn favour
The group considers the agreement good, but calls at the same time for measures and a bilateral agreement with Sweden to resolve what is perceived as unfair taxation of pensioners.
”Tässä kohdassa haluaisin tietysti sanoa sen, että tämä asia on erittäin hyvä ja haluaisin kiirehtiä meidän hallitustamme purkamaan myöskin kaksoisverotuksen Ruotsin kanssa.”
— Maria Tolppanen - Centre PartyIn favour
The group supports updating the tax treaty with a key export partner and emphasises EU-level rules of the game in preventing tax avoidance without hampering normal business operations.
”On erittäin hyvä asia, että päivitetään nämä kahdenväliset verosopimukset.”
— Antti Kurvinen - Social DemocratsIn favour
The group considers reforming the bilateral tax treaty necessary, but demands stronger national measures and legislative amendments from the Government to close loopholes in international tax planning.
”Nämä kahdenväliset verosopimukset on syytä päivittää, mutta kansainvälistyvässä maailmassa maiden rajojen ylittävä voiton pimitys ja veron välttely vaatii yhteistä kansainvälistä toimintaa.”
— Timo Harakka - GreensIn favour
The group supports the agreement and calls for resolute action from the Government to root out tax avoidance both at EU level and in national legislation.
”Täällä on muun muassa edustaja Kurvinen todennut, että hallitus on sitoutunut toimimaan aggressiivista verosuunnittelua ja verovälttelyä vastaan. Hyvä, jos näin on.”
— Satu Hassi
