Laki henkilötietojen käsittelystä poliisitoimessa 40 §:n muuttamisesta
Eduskunnan päätöksen mukaisesti muutetaan henkilötietojen käsittelystä annetun lain (761/2003) 40 §, sellaisena kuin se on laissa 1181/2013, seuraavasti:
40 §Prümin sopimukseen ja Prüm-päätökseen perustuva tietojen käsittely
Belgian kuningaskunnan, Saksan liittotasavallan, Espanjan kuningaskunnan, Ranskan tasavallan, Luxemburgin suurherttuakunnan, Alankomaiden kuningaskunnan ja Itävallan tasavallan välillä rajat ylittävän yhteistyön tehostamisesta erityisesti terrorismin, rajat ylittävän rikollisuuden ja laittoman muuttoliikkeen torjumiseksi tehdyn sopimuksen (SopS 54/2007), jäljempänä Prümin sopimus, nojalla saadut tiedot poistetaan noudattaen muualla tässä laissa säädetyn lisäksi, mitä sopimuksen 37 artiklan 3 kohdassa määrätään. Rajat ylittävän yhteistyön tehostamisesta erityisesti terrorismin ja rajat ylittävän rikollisuuden torjumiseksi tehdyn neuvoston päätöksen (2008/615/YOS), jäljempänä Prüm-päätös, nojalla saadut tiedot poistetaan noudattaen muualla tässä laissa säädetyn lisäksi, mitä Prüm-päätöksen 14 artiklan 2 kohdassa, 26 artiklan 2 ja 3 kohdassa sekä 28 artiklan 3 kohdassa säädetään.
Prümin sopimukseen ja Prüm-päätökseen perustuvaa tietojen käsittelyä koskevat lokitiedot ja valvontatiedot säilytetään ja poistetaan noudattaen, mitä sopimuksen 39 artiklan 4 ja 5 kohdissa määrätään ja mitä päätöksen 30 artiklan 4 ja 5 kohdassa säädetään.
Jokaisella on oikeus muualla tässä laissa säädetyn lisäksi pyytää tietosuojavaltuutettua varmistamaan, että häntä koskevien henkilötietojen Prümiin sopimukseen ja Prüm päätökseen perustuva käsittely tapahtuu lainmukaisesti.

Tämä laki tulee voimaan päivänä kuuta 20.
