Laki eläketukilain muuttamisesta
Eduskunnan päätöksen mukaisesti muutetaan eläketukilain (1531/2016) 2 §:n otsikko ja 26 § sekä lisätään lakiin uusi 2 a § seuraavasti:
2 §Ennen 1 päivä syyskuuta 1956 syntyneen henkilön oikeus eläketukeen
2 a §Ennen 1 päivä syyskuuta 1958 syntyneen henkilön oikeus eläketukeen
Eläketuki voidaan myöntää myös Suomessa asuvalle ennen 1 päivä syyskuuta 1958 syntyneelle henkilölle, jolle ei ole myönnetty eläketukea 2 §:n perusteella. Eläketukea maksetaan sen kuukauden loppuun, jonka aikana henkilö täyttää 65 vuotta.
Eläketuen myöntäminen 1 momentin perusteella edellyttää, että henkilö on ollut oikeutettu työmarkkinatukeen 31 päivänä elokuuta 2018 ja että hänelle on maksettu 1 päivänä syyskuuta 2012 tai sen jälkeen ja viimeistään 31 päivänä elokuuta 2018 työttömyysturvalain mukaista työmarkkinatukea vähintään 1 250 päivältä tai enimmäisaika työttömyysturvalain mukaista päivärahaa ja sen lisäksi työmarkkinatukea vähintään 750 päivältä.
Edellä 2 momentissa tarkoitettuna 31 päivänä elokuuta 2018 työmarkkinatukeen oikeutettuna henkilönä pidetään tätä lakia sovellettaessa lisäksi työttömyysturvalain 10 luvun 2 §:n 3 momentin 1, 2 tai 4—6 kohdassa tarkoitettua henkilöä, kuntouttavasta työtoiminnasta annetun lain 3 §:ssä tarkoitettua henkilöä, työttömyysturvalain 3 luvun 3 §:n 1 momentissa tarkoitettua työkyvytöntä henkilö, joka saa sairausvakuutuslain mukaista sairauspäivärahaa, henkilöä, joka saa Kansaneläkelaitoksen kuntoutusetuuksista ja kuntoutusrahaetuuksista annetun lain mukaista kuntoutusrahaa sekä työkyvytöntä henkilöä, joka saa tämän lain 3 §:ssä mainitun lain perusteella myönnettyä kuntoutustukea.
Edellä 2 momentissa tarkoitettuihin päiviin, joilta henkilölle on maksettu työmarkkinatukea, lasketaan mukaan lisäksi työttömyysturvalain 10 luvun 2 §:n 3 momentin 4—6 kohdan mukaiset päivät, kuntouttavasta työtoiminnasta annetun lain 3 §:n mukaiset päivät, jolloin henkilö on ollut kuntouttavassa työtoiminnassa, työttömyysturvalain 3 luvun 3 §:n 1 momentin mukaiset päivät, joilta henkilö on saanut sairausvakuutuslain mukaista sairauspäivärahaa sekä päivät, joilta henkilö ei ole ennen vuotta 2013 saanut työmarkkinatukea työttömyysturvalain 9 luvun 3 ja 4 §:n mukaisesti, sellaisina kuin ne olivat voimassa 31 päivänä joulukuuta 2012, puolison tuloja koskevan tarveharkinnan perusteella.
26 §Voimaantulo
Tämä laki tulee voimaan 1 päivänä kesäkuuta 2017.
Eläketukea maksetaan 2 §:n perusteella aikaisintaan vuoden 2017 kesäkuun alusta lukien. Eläketukea maksetaan 2 a §:n perusteella aikaisintaan vuoden 2019 lokakuun alusta lukien.

Tämä laki tulee voimaan päivänä kuuta 20 .
