What is proposed
A provision will be added to the act allowing the scope of an attorney's kinship-based disqualification to be narrowed by a provision included in the power of attorney. Under the provision, the attorney may represent the grantor in legal transactions with, for example, their sibling or grandchild. Derogations will still not be permitted for the closest relationships, such as legal transactions with the attorney themselves or their child, and the rule will apply only to powers of attorney executed after the act enters into force.
What it means
The amendment will facilitate the management of affairs and property arrangements among relatives, particularly for older people, and reduce the costs and delays caused by administrative procedures. In the long term, the reform will reduce applications submitted to the Digital and Population Data Services Agency and public guardianship services for the appointment of substitutes. At the same time, the careful drafting of continuing powers of attorney will become increasingly important so that provisions do not lead to abuse. The act is intended to enter into force in spring 2027.

— Terhi Koulumies - Finns PartyIn favour
The Finns Party supports the proposal because it reduces unnecessary bureaucracy and enables people to entrust the management of their affairs to a close person without unnecessary official intervention.
”Tässä erinomaisessa esityksessä yhdistyy käytännön asioiden helpottaminen, turhan byrokratian vähentäminen ja ihmisen oman päätösvallan kunnioittaminen.”
— Juho Eerola - Social DemocratsIn favour with reservations
The Social Democrats consider the legislative proposal to be a step in the right direction and necessary, but point out that easing disqualification rules and reducing supervision may increase the risk of abuse.
— Lauri Lyly - Centre PartyIn favour
The Centre Party considers the legislative proposal very important, as clear and flexible rules prevent difficult conflict situations in advance when functional capacity declines.
