Laki opintotukilain 17 ja 19 §:n muuttamisesta
Eduskunnan päätöksen mukaisesti muutetaan opintotukilain (65/1994) 17 § :n 1 momentti ja 19 §, sellaisina kuin ne ovat, 17 §:n 1 momentti laissa 52/2011 ja 19 § laeissa 960/2017 ja / , seuraavasti:
17 §Opiskelijan omien tulojen vaikutus opintorahaan ja asumislisään
Opiskelijalla voi olla opintorahan lisäksi muita veronalaisia tuloja kalenterivuodessa määrä, jota kutsutaan vapaaksi tuloksi. Vapaa tulo lasketaan siten, että opiskelijalla voi olla tuloa:
1) 660 euroa jokaista kuukautta kohden, jolta hän on saanut opintorahaa tai asumislisää; sekä
2) 1 970 euroa jokaista kuukautta kohden, jolta hän ei ole saanut opintorahaa tai asumislisää.
19 §Vanhempien tulojen huomioon ottaminen
Muiden kuin korkeakouluopiskelijoiden vanhempien tulot otetaan huomioon opintorahaa myönnettäessä, jos opiskelija on alle 20-vuotias ja asuu vanhempansa luona. Tulot otetaan huomioon mainitun ikärajan täyttämistä edeltävän kalenterikuukauden loppuun. Vanhempien tuloja ei kuitenkaan oteta huomioon, jos opiskelija on avioliitossa tai saa opintorahan huoltajakorotusta. Jos opiskelijan vanhemmat ovat eronneet tai asuvat pysyvästi välien rikkoutumisen vuoksi erillään, vain sen vanhemman tulot otetaan huomioon, jonka luona opiskelija asuu tai on viimeksi asunut. Jos opiskelija on alle 18-vuotias ja hän on vanhempansa ja vanhemman uuden aviopuolison yhteisessä kodissa huollettavana, myös uuden aviopuolison tulot otetaan huomioon.
Opiskelijalla on oikeus 11 §:n 1 momentin 1 kohdan mukaiseen opintorahaan, jos vanhempien veronalaisten ansio- ja pääomatulojen yhteismäärä on enintään 43 000 euroa vuodessa. Opintorahaa vähennetään jokaista tulorajan ylittävää täyttä 1 070:tä euroa kohden viisi prosenttiyksikköä.
§
Tämä laki tulee voimaan päivänä kuuta 20 . Sen 19 § tulee kuitenkin voimaan 1 päivänä elokuuta 2019. Lain 17 §:n 1 momenttia sovelletaan ennen vuotta 2021 tehtävään tulovalvontaan, joka koskee aikaa ennen vuotta 2019 sellaisena kuin se oli voimassa tämän lain voimaan tullessa.
