Laki perintö- ja lahjaverolain muuttamisesta
Eduskunnan päätöksen mukaisesti kumotaan perintö- ja lahjaverolain (378/1940) 7 a §:n 2 ja 3 momentti, sellaisina kuin ne ovat, 2 momentti laissa 909/2001 ja 3 momentti laissa 1744/2009, muutetaan 12 §:n 1 momentti sekä 14 ja 19 a §, sellaisina kuin ne ovat, 12 §:n 1 momentti laissa 1063/2007 sekä 14 ja 19 a § laissa 1082/2014, sekä lisätään 52 §:ään, sellaisena kuin se on laeissa 318/1994 ja 1561/1995, uusi 3 momentti seuraavasti:
12 §
Veronalaisesta perintöosuudesta saavat vähentää:
1) perinnönjättäjän puoliso ja henkilö, johon 11 §:n 3 momentin mukaan sovelletaan puolisoa koskevia säännöksiä, 90 000 euroa (puolisovähennys) ;
2) sellainen perinnönjättäjän suoraan alenevassa polvessa oleva perillinen, jolla perinnönjättäjän kuolinhetkellä lähinnä oli oikeus periä perinnönjättäjä ja joka tuolloin ei ollut täyttänyt 18 vuotta, 60 000 euroa (alaikäisyysvähennys ).

Perintöveroa maksetaan I veroluokassa seuraavan asteikon mukaan:

Maksamatta olevaa perintöveroa, sen korotusta ja viivästysseuraamusta ei kuitenkaan peritä ulosottoteitse eikä niiden perusteella haeta verovelvollisen asettamista konkurssiin eikä tietoa niistä merkitä verotustietojen julkisuudesta ja salassapidosta annetussa laissa (1346/1999) säädettyyn verovelkarekisteriin ennen kuin kaksi vuotta on kulunut veron ensimmäisestä eräpäivästä.
§
Tämä laki tulee voimaan päivänä kuuta 20 . Lain 52 §:n 3 momentti tulee kuitenkin voimaan päivänä kuuta 20 .
Jos verovelvollisuus on alkanut ennen tämän lain voimaantuloa, sovelletaan tämän lain voimaan tullessa voimassa olleita säännöksiä. Lain 52 §:n 3 momenttia sovelletaan kuitenkin myös, jos verovelvollisuus on alkanut ennen tämän lain voimaantuloa ja veron ensimmäinen eräpäivä on 1 päivänä marraskuuta 2017 tai sen jälkeen.
Jos perintöverotusta toimitettaessa pesän varoihin on lisättävä ennen tämän lain voimaantuloa annettu 16 §:n 1 momentissa tarkoitettu lahja, perintöverosta vähennettävä määrä lasketaan tämän lain 19 a §:n mukaan.
Jos lahjaveroa määrättäessä on otettava huomioon ennen tämän lain voimaantuloa annettu 20 §:n 2 momentissa tarkoitettu lahja, lahjojen yhteismäärästä määrättävästä lahjaverosta vähennettävä määrä lasketaan tämän lain 19 a §:n mukaan.
