What is proposed

A provision on a national service centre for digital and ICT solutions will be added to the Act on the Organisation of Health and Social Services. The general requirement under the Public Procurement Act of a minimum ownership share of 10 per cent to obtain in-house entity status will not apply to the company. The exemption applies to national health and social services and solutions, but it does not extend to rescue services.

What it means

The amendment concerns the state, 21 wellbeing services counties, the City of Helsinki and the HUS Group, which jointly own the company. Because the counties' ownership shares are only a few per cent, without the legislative amendment they would lose the possibility to use DigiFinland as their in-house entity and would have to tender the services separately. The counties will continue to be able to introduce centralised health and social services solutions voluntarily, such as the Medical Helpline 116117 and Omaolo services. The use of the company's services will remain voluntary, and the proposal has no direct impacts on the central government budget.

Key points of the debate

The debate addressed enacting an exemption to the Public Procurement Act so that the state and wellbeing services counties can continue to procure DigiFinland's services without tendering. The bill was completely unanimous, and all groups considered it important to safeguard the continuity of nationwide digital solutions. The opposition did point out, however, that the need for an exemption stemmed from design flaws in the previously implemented public procurement reform.

  • Finns PartyIn favour

The Finns Party (Finns) supports the proposal because it ensures the continuity of shared and functional digital health and social services and prevents the fragmentation of systems. The proposal improves information flow and patient safety without obliging the counties to purchase services.

”Näin turvataan tärkeiden valtakunnallisten palvelujen jatkuvuus ja niiden suunnitelmallinen kehittäminen.”
    — Wille Rydman
  • The Social Democrats (SDP) consider safeguarding the continuity of DigiFinland's operations justified so that nationwide health and social services systems do not have to be built separately in each county. The group emphasises that care must be taken to ensure the efficient use of public funds and transparency in pricing.

”DigiFinlandin toiminnan jatkuvuuden turvaaminen on perusteltua näiden hyvien, laajasti käyttöön otettujen palveluiden ylläpitämiseksi ja kehittämiseksi.”
    — Hanna Laine-Nousimaa
  • Centre PartyIn favour

The Centre Party (Cen) considers the proposal very commendable and good so that functional shared services such as Omaolo can be secured. However, the group notes that the proposal for an exemption shows what kind of problems the strict in-house entity limits of the Public Procurement Act cause for the public sector.

”Tämä laki on selkeästi hyvä laki, joka korjaa hankintalain virheitä.”
    — Anne Kalmari
