Laki tiedustelutoiminnan valvonnasta annetun lain muuttamisesta
Eduskunnan päätöksen mukaisesti lisätään tiedustelutoiminnan valvonnasta annettuun lakiin (121/2019) uusi 20 a § seuraavasti:
20 a §Tiedusteluvalvontavaltuutetun sijainen
Tiedusteluvalvontavaltuutetulla on sijainen, joka tiedusteluvalvontavaltuutetun ollessa estyneenä hoitaa hänen tästä laista johtuvia tehtäviään vastaavin toimivaltuuksin.
Sijaisen kelpoisuusvaatimuksena on soveltuva ylempi korkeakoulututkinto ja hyvä perehtyneisyys viran tehtäväalaan. Sijaisella ei saa olla sellaisia sidonnaisuuksia, jotka ovat omiaan vaarantamaan valvontatehtävän asianmukaista ja riippumatonta hoitamista.
Valtioneuvosto määrää sijaisen valtuutetun henkilöstöstä kolmeksi vuodeksi kerrallaan. Ennen määräyksen antamista on kuultava tiedusteluvalvontavaltuutettua ja varattava tiedusteluvalvontavaliokunnalle tilaisuus lausua mielipiteensä asiasta. Määräys sijaiseksi päättyy, kun sijainen ei enää kuulu valtuutetun henkilöstöön tai on muutoin estynyt hoitamasta valtuutetun henkilöstölle kuuluvia tehtäviä.
