Eduskunnan päätöksen mukaisesti
§
muutetaan biopolttoöljyn käytön edistämisestä annetun lain (418/2019) 5 §:n 1 momentti seuraavasti:
5 §Biopolttoöljyn kulutukseen toimittaminen
Jakelija on velvollinen toimittamaan biopolttoöljyä kulutukseen. Biopolttoöljyn energiasisällön osuus jakelijan kulutukseen toimittaman kevyen polttoöljyn ja biopolttoöljyn energiasisällön kokonaismäärästä (jakeluvelvoite ) tulee olla vähintään:
1) 3,0 prosenttia vuonna 2021;
2) 4,0 prosenttia vuonna 2022;
3) 5,0 prosenttia vuonna 2023;
4) 6,0 prosenttia vuonna 2024;
5) 7,0 prosenttia vuonna 2025;
6) 11,6 prosenttia vuonna 2026;
7) 16,2 prosenttia vuonna 2027;
8) 20,8 prosenttia vuonna 2028;
9) 25,4 prosenttia vuonna 2029;
10) 30,0 prosenttia vuonna 2030 ja sen jälkeen.
§
Tämä laki tulee voimaan päivänä kuuta 20 .
2.Laki biopolttoaineista, bionesteistä ja biomassapolttoaineista annetun lain 2 ja 38 §:n muuttamisesta
Eduskunnan päätöksen mukaisesti muutetaan biopolttoaineista, bionesteistä ja biomassapolttoaineista annetun lain (393/2013) 2 §:n 1 momentti ja 38 §:n 1 momentti, sellaisina kuin ne ovat, 2 §:n 1 momentti laissa 604/2021 sekä 38 §:n 1 momentti laissa 388/2017, seuraavasti:
2 §Lain suhde muuhun lainsäädäntöön
Tätä lakia sovelletaan biopolttoaineisiin, bionesteisiin ja biomassapolttoaineisiin seuraavien lakien mukaisesti:
1) uusiutuvien polttoaineiden käytön edistämisestä liikenteessä annettu laki (446/2007), jäljempänä jakeluvelvoitelaki ;
2) nestemäisten polttoaineiden valmisteverosta annettu laki (1472/1994);
3) päästökauppalaki (311/2011);
4) lentoliikenteen päästökaupasta annettu laki (34/2010);
5) eräiden polttoaineiden elinkaarenaikaisten kasvihuonekaasupäästöjen vähentämisestä annettu laki (170/2018);
6) biopolttoöljyn käytön edistämisestä annettu laki (418/2019);
7) sähkön ja eräiden polttoaineiden valmisteverosta annettu laki (1260/1996).
38 §Ennakkotieto
Energiavirasto voi toiminnanharjoittajan hakemuksesta päättää antaa ennakkotiedon siitä, onko raaka-ainetta pidettävä jätteenä, tähteenä, syötäväksi kelpaamattomana selluloosana tai lignoselluloosana sovellettaessa nestemäisten polttoaineiden valmisteverosta annettua lakia tai sähkön ja eräiden polttoaineiden valmisteverosta annettua lakia.
§
Tämä laki tulee voimaan päivänä kuuta 20 .
Toiminnanharjoittaja voi lain 23 §:ssä säädetyn estämättä osoittaa jo ennen 13 §:n mukaisen hyväksymishakemuksen jättämistä vuoden 2023 aikana tuotetut, valmistetut tai käytetyt biokaasuerät ja niiden raaka-aine-erät kestäviksi, jos se toimittaa hakemuksen Energiavirastolle viimeistään 31 päivänä joulukuuta 2023 ja pystyy osoittamaan, että sillä on ollut käytössä asianmukaiset menettelyt kestävyyskriteereiden täyttymisen varmistamiseksi ja erä on luotettavasti kirjattu ainetaseeseen. Edellytyksenä on lisäksi, että toiminnanharjoittajaan sovelletaan sähkön ja eräiden polttoaineiden valmisteverosta annettua lakia (1260/1996).
