What is proposed

A temporary exemption applicable to the year 2026 will be added to the Income Tax Act, according to which provisions on unlimited tax liability on the basis of the place of effective management will not be applied to UCITS and alternative investment funds (AIFs) established or registered in another EEA state.

What it means

The amendment applies to investment funds and alternative investment funds registered in EEA states and to their Finnish management companies. Extending the exemption ensures operational certainty in taxation for the sector for 2026 while the Ministry of Finance prepares a permanent solution compliant with EU state aid rules. The act will be in force from 1 January (1.1) to 31 December 2026 and will apply to taxation for the tax year 2026.

How Parliament voted

The bill passed without a vote – no MP proposed rejecting or amending it in plenary.

Key points of the debate

The debate addressed extending the temporary tax exemption for foreign investment funds by one year. The proposal was supported unanimously in Parliament, with the additional time considered necessary to protect jobs in the sector and Finland's competitiveness. Both government and opposition parties hoped that a permanent solution compliant with EU rules would be prepared as soon as possible.

  • Extending the tax exemption maintains operational certainty for the fund sector and prevents management operations and jobs from fleeing abroad.

Tämä ei ole keino verovälttelyyn. Tämä on keino säilyttää Suomen vetovoima rahastojen hallinnointipaikkana.
    Juha Hänninen
  • Finns PartyIn favour

Extending the exemption by one year is essential to safeguard jobs in the fund sector and give the Ministry of Finance time to negotiate a legally robust permanent solution with the European Commission under EU law.

Määräaikaisella rahastopoikkeuksella on pyritty luomaan oikeusvarmuutta toimialalle.
    Riikka Purra
  • A temporary exemption is justified to maintain predictability for the sector and preserve Finland's competitiveness, but finding a permanent solution must remain the objective.

Siltä osin minusta on ihan perusteltua säätää tämä poikkeus nyt ja toivoa todella, että saisimme sitten jonkun pysyvämmän ratkaisun syntymään.
    Joona Räsänen
  • Left AllianceIn favour with reservations

Granting additional time is understandable given that preparations are still unfinished, but repeated extensions of temporary exemptions should be avoided and permanent rules resolved without delay.

Pitää kuitenkin olla varovainen siinä, että poikkeuksia ei automaattisesti jatketa vuodesta toiseen, koska poikkeus on nimensä mukaisesti poikkeus, ei pysyvä ratkaisu.
