What is proposed

Provisions would be added to the Assessment Procedure Act requiring Finnish financial institutions to comply with due diligence procedures under the OECD's Common Reporting Standard (CRS) in identifying customers residing outside the EU and to report details of their income and assets to the Finnish Tax Administration.

What it means

The change would affect Finnish financial institutions, which would have to examine their customer accounts and retain records of the measures taken for six years. In turn, the Finnish Tax Administration would receive data from abroad on the income and assets of Finnish residents, increasing tax revenue and making tax control more effective. One-off IT system costs for the Finnish Tax Administration are estimated at 150,000–200,000 euros, and automatic information exchange would begin with data for tax year 2016 by September 2017.

Key points of the debate

Parliament debated the proposal to expand the automatic international exchange of tax information to prevent tax evasion. The debate was unanimous, with all parliamentary groups backing the proposal as an important step in tackling the shadow economy. The opposition also called for even broader follow-up measures, such as country-by-country tax reporting for multinational enterprises.

  • Finns PartyIn favour

The Finns Party considered the proposal positive, noting that enhanced identification and reporting obligations for financial institutions improve authorities' access to information and narrow banking secrecy.

”Minun mielestäni tämä on oikein hyvää lainsäädäntöä.”
    — Ville Vähämäki
  • Centre PartyIn favour

The Centre Party supported the proposal as a long-lasting and effective way to hamper tax evasion and improve tax control through international information exchange.

”Hallituksen esitys eduskunnalle verotusmenettelystä annetun lain muuttamiseksi on erittäin hyvä ja perusteltu.”
    — Hannu Hoskonen
  • The Social Democrats backed the proposal as a necessary step towards eradicating international tax evasion, but called for even more decisive further measures to curb tax avoidance and the shadow economy.

  • Left AllianceIn favour

The Left Alliance supported the proposal as a step in the right direction regarding tax transparency, but considered it insufficient and called for measures such as country-by-country tax reporting for businesses.

”Esitys on askel oikeaan suuntaan verotietojen avoimuuden lisäämiseksi ja veronkierron torjumiseksi.”
    — Hanna Sarkkinen

§

Tämä laki tulee voimaan päivänä kuuta 20 .

Main content of the bill (official)
Esityksessä ehdotetaan verotusmenettelystä annettua lakia muutettavaksi siten, että suomalaiset finanssilaitokset velvoitettaisiin selvittämään nykyistä laajemmin asiakkaittensa verotuksellinen asuinvaltio kansainvälisesti hyväksytyllä huolellisuusmenettelyllä ja toimittamaan näiden verotusta koskevia tulo- ja varallisuustietoja Verohallinnolle. Ehdotetulla muutoksella varmistettaisiin, että Suomi voi osallistua finanssitilitietojen automaattiseen tietojenvaihtoon Taloudellisen yhteistyön ja kehityksen järjestön, OECD:n valmisteleman yhteisen raportointistandardin mukaisesti. Finanssitilitietojen automaattisen tietojenvaihdon avulla Suomi saisi Suomessa asuvien henkilöiden verotukseen vaikuttavia tietoja näiden ulkomailla olevista varoista ja niiden tuotoista. Laki on tarkoitettu tulemaan voimaan mahdollisimman pian.
