Laki asevelvollisuuslain 32 ja 48 §:n muuttamisesta
Eduskunnan päätöksen mukaisesti muutetaan asevelvollisuuslain (1438/2007) 32 §:n 1, 3 ja 4 momentti ja 48 §, sellaisina kuin niistä ovat 32 §:n 3 ja 4 momentti laissa 500/2016, seuraavasti:
32 §Kertausharjoitukseen määrääminen
Kertausharjoitukseen voidaan määrätä reserviin kuuluva asevelvollinen. Rajaturvallisuuden ylläpitämistä koskevaan 48 §:n 5 kohdassa tarkoitettuun kertausharjoitukseen voidaan kuitenkin määrätä vain rajavartiolaitoksen hallinnosta annetun lain 2 §:ssä tarkoitettuihin rajajoukkoihin sijoitettu reserviläinen.
Suomen turvallisuusympäristössä ilmenevän välttämättömän tarpeen sitä edellyttäessä voidaan reserviin kuuluvia asevelvollisia määrätä 48 §:n 4 ja 5 kohdassa tarkoitettuun kertausharjoitukseen 2 momentissa säädetystä määräajasta poiketen. Määräys kertausharjoitukseen annetaan kunkin asevelvollisen osalta enintään 30 päiväksi kerrallaan.
Päätöksen 3 momentissa tarkoitetusta kertausharjoituksesta tekee tasavallan presidentti Puolustusvoimain komentajan esittelystä puolustusvoimista annetun lain 32 §:n 2 momentissa tarkoitetussa päätöksentekomenettelyssä siten, että puolustusministerin tulee olla läsnä ja lausua käsityksensä asiasta. Lisäksi pääministeri voi olla läsnä ja lausua käsityksensä asiasta. Sotilaskäskyasian siirtämisestä tasavallan presidentin valtioneuvostossa ratkaistavaksi säädetään puolustusvoimista annetun lain 32 §:n 3 momentissa. Jos kyse on yksinomaan rajaturvallisuuden välttämättömäksi ylläpitämiseksi määrättävästä kertausharjoituksesta, päätös tehdään kuitenkin noudattaen rajavartiolaitoksen hallinnosta annetun lain 7 §:n 2 ja 3 momentissa säädettyä sotilaskäskyasioiden päätöksentekomenettelyä. Tässä momentissa tarkoitettu tasavallan presidentin päätös ja sen nojalla annetut määräykset on peruutettava, kun kertausharjoitukseen johtanut tilanne sen sallii.
48 §Kertausharjoituksen tarkoitus
Reservin kertausharjoituksilla:
1) pidetään yllä varusmiespalveluksen aikana saatuja sotilaallisia tietoja ja taitoja sekä koulutetaan vaativampiin tehtäviin;
2) perehdytetään asevelvolliset sotilaallisessa maanpuolustuksessa tapahtuneen kehityksen mukanaan tuomiin muutoksiin;
3) harjoitetaan joukkokokonaisuuksia niille suunnitelluissa kokoonpanoissa;
4) mahdollistetaan sotilaallisen valmiuden joustava kohottaminen;
5) mahdollistetaan rajaturvallisuuden ylläpitäminen, jos se on välttämätöntä rajaturvallisuustilanteesta johtuen.
§
Tämä laki tulee voimaan päivänä kuuta 20 .
