Laki yhdistetyn patenttituomioistuimen paikallisjaostosta Suomessa
Eduskunnan päätöksen mukaisesti säädetään:
1 §Yhdistetyn patenttituomioistuimen paikallisjaosto
Suomessa on yhdistetystä patenttituomioistuimesta Brysselissä 19 päivänä helmikuuta 2013 tehdyn sopimuksen 7 artiklan 1 kohdassa tarkoitettu yhdistetyn patenttituomioistuimen ensimmäisen asteen tuomioistuimen paikallisjaosto, jäljempänä paikallisjaosto .
2 §Paikallisjaoston sijainti
Paikallisjaosto sijaitsee Helsingissä.
3 §Oikeudenkäynnin kieli
Paikallisjaosto käyttää asian käsittelykielenä joko suomea, ruotsia tai englantia ja antaa ratkaisunsa käsittelykielellä. Asian käsittelemisestä ja ratkaisemisesta kielellä, jolla patentti on myönnetty, määrätään yhdistetystä patenttituomioistuimesta tehdyn sopimuksen 49 artiklan 3—5 kohdassa.
Jos käsittelykieli yhdistetyn patenttituomioistuimen työjärjestyksen 14 säännön 2 kohdan b alakohdan mukaan on joko suomi tai ruotsi, ja asianosaiset eivät sovi käytettävästä kielestä, asia käsitellään vastaajan kielellä.
4 §Voimaantulo
Tämän lain voimaantulosta säädetään valtioneuvoston asetuksella.
