Laki ympäristönsuojelulain muuttamisesta
Eduskunnan päätöksen mukaisesti lisätään ympäristönsuojelulakiin (527/2014) uusi 182 a § seuraavasti:
182 a §Viranomaisen toimivalta eräissä tilanteissa
Jos ympäristön pilaantumisen vaaraa aiheuttavasta toiminnasta aiheutuu tai uhkaa aiheutua vakavaa vaaraa tai vakavaa haittaa terveydelle tai ympäristölle, valtion valvontaviranomainen voi ryhtyä sellaisiin ympäristön pilaantumisen ehkäisemiseksi tai rajoittamiseksi välttämättömiin toimiin, jotka eivät pelastuslain 32 §:n mukaan kuulu pelastustoimintaan. Edellytyksenä toimiin ryhtymiselle on lisäksi, että:
1) toimien toteuttamista ei voida toiminnasta vastaavan tahon tosiasiallisen toimintakyvyn puuttumisen vuoksi varmistaa tämän lain 175 §:ssä tarkoitetussa menettelyssä; tai
2) toiminnasta vastaavaa tahoa ei viivytyksettä saada selville.
Toiminnasta vastaavaa tahoa on mahdollisuuksien mukaan kuultava ennen toimiin ryhtymistä. Toimista on laadittava pöytäkirja ja toimista on tehtävä päätös viivytyksettä.
Toimista viranomaiselle aiheutuneista kustannuksista vastaa toiminnasta vastaava taho. Viranomaiselle aiheutuneiden kustannusten perinnästä säädetään verojen ja maksujen täytäntöönpanosta annetussa laissa (706/2007).

Tämä laki tulee voimaan päivänä kuuta 20 .
