Restricting health and social services investments
Act amending sections 4 and 6 of the Act on the Temporary Restriction of Certain Legal Transactions of Municipalities and Joint Municipal Authorities in Health and Social Services
Major health and social services construction projects by companies owned by municipalities and joint municipal authorities will become subject to an exemption permit procedure before the health and social services reform. Any financial consequences of unlawful contracts will fall directly on the municipalities and their companies rather than on financiers.

What is proposed
Health and social services construction investments of more than 5 million euros by companies wholly owned by municipalities and joint municipal authorities are assimilated to municipalities' own projects, meaning they require an exemption permit from the ministry. In addition, provision is made that liability for the invalidity and costs of an unlawful contract rests with the municipality, joint municipal authority, or company owned by it.
What it means
The amendment prevents municipalities from circumventing health and social services investment restrictions through incorporation before the health and social services reform enters into force. It clarifies the position of financiers and prevents the transfer of financial liabilities to future health and social services areas. The regulation applies to municipalities, joint municipal authorities, their property companies, and financial institutions, and it will enter into force as soon as possible.
How Parliament voted
The act ultimately passed without a vote: no MP proposed rejecting it in the final reading. The only vote concerned a detail of the act.

Key points of the debate
The debate addressed extending the act restricting municipalities' and joint municipal authorities' health and social services construction investments to municipally owned companies ahead of the upcoming health and social services reform. The government parties considered the proposal essential to close loopholes and safeguard the room for manoeuvre of the future wellbeing services counties. The opposition parties understood the aim of the act, but criticised the continuous chaining of the restriction act intended to be temporary, bureaucracy, and project delays.
- Is the continuous chaining and tightening of the temporary restriction act justified before the health and social services reform is completed?
- Does the exemption permit threshold of 5 million euros slow down necessary healthcare construction investments and create excessive bureaucracy?
- Social DemocratsIn favour
Extending the restriction act to municipal companies is essential so that the method of implementing investments does not determine the application of regulation, and the operating conditions of future health and social services areas are safeguarded.
”Tarkoituksena on osaltaan tukea sitä, ettei ennen uudistuksen voimaantuloa sidottaisi uusien sote-maakuntien mahdollisuuksia.”
— Krista Kiuru - Centre PartyIn favour
The proposal ensures that decisions making it harder to organise the services of future regions are not taken before the reform, while still allowing necessary and acute repairs.
”Tämän esityksen tarkoituksena on, että ennen sote-uudistuksen voimaantuloa ei tehtäisi päätöksiä, joilla vaikeutettaisiin tulevien maakuntien mahdollisuuksia päättää palveluista koko maakunnan alueella”
— Pasi Kivisaari - GreensIn favour
The legislative amendment is necessary and commendable to prevent actions detrimental to health and social services structures before the reform enters into force, without preventing necessary projects.
”Tämän vuoksi tämä esitys on erittäin kannatettava.”
— Sofia Virta - Left AllianceIn favour
The loophole concerning municipal companies must be closed to prevent expensive and inappropriate outsourcing and investments before the reform.
— Hanna Sarkkinen - Swedish People's PartyIn favour
Extending the scope of the act to companies prevents circumvention of the law, even though the long-standing temporary regulation and the delay of the health and social services reform raise concern.
— Mikko Ollikainen - National Coalition PartyIn favour with reservations
Patching loopholes is considered good as such, but the chaining over years of a restriction act intended to be temporary and the effects on regional services draw serious criticism.
— Timo Heinonen - Finns PartyIn favour with reservations
The objective of the act to prevent sub-optimisation is understandable, but the investment threshold of 5 million euros is too low and the exemption permit procedure increases bureaucracy and slows down necessary projects.
— Arja Juvonen - Christian DemocratsIn favour with reservations
The objective of the restriction act is acceptable, but the repeated tightening of the provisions without an overall review causes uncertainty and problems in municipalities and regions.

6 §Lain vastaisen sopimuksen sitomattomuus
