1.Laki ikääntyneen väestön toimintakyvyn tukemisesta sekä iäkkäiden sosiaali- ja terveyspalveluista annetun lain 20 §:n muuttamisesta
Eduskunnan päätöksen mukaisesti muutetaan ikääntyneen väestön toimintakyvyn tukemisesta sekä iäkkäiden sosiaali- ja terveyspalveluista annetun lain (980/2012) 20 §:n 2 momentti, sellaisena kuin se on laissa 876/2022, seuraavasti:
20 §Henkilöstö
Toteutuneen henkilöstömitoituksen on oltava vähintään 0,6 työntekijää asiakasta kohti sosiaalihuoltolain 21 c §:ssä tarkoitetun ympärivuorokautisen palveluasumisen toimintayksikössä, jolla on yhteiset toimitilat ja oma työvuorosuunnittelu ja joka toimii yhden esimiehen alaisuudessa. Toteutunut henkilöstömitoitus tarkoittaa toimintayksikössä paikalla olevien välitöntä asiakastyötä tekevien 3 a §:ssä tarkoitettujen työntekijöiden työpanosta suhteessa toimintayksikössä kolmen viikon seurantajakson aikana olevien asiakkaiden määrään. Välillistä työtä ei oteta huomioon henkilöstömitoituksessa.
§
Tämä laki tulee voimaan päivänä kuuta 20 .
Poiketen siitä, mitä sosiaali- ja terveydenhuollon valvonnasta annetun lain (741/2023) 5 §:n 2 momentissa, 16 §:n 2 momentissa ja 21 §:ssä säädetään, palveluntuottaja voi muuttaa ympärivuorokautisen palveluasumisen henkilöstömitoituksen tämän lain 20 §:n mukaiseksi ilman hakemusta ja päätöstä rekisteröinnin muutoksesta. Palveluntuottajan on päivitettävä muutos valtakunnalliseen sosiaali- ja terveydenhuollon palveluntuottajien ja palveluyksikköjen rekisteriin sosiaali- ja terveydenhuollon valvonnasta annetun lain 17 §:n 1 momentissa tarkoitetulla tavalla.
Muutos ja rekisteritietojen päivitys on tehtävä viimeistään 31 päivänä joulukuuta 2025. Jos muutos tehdään tai tiedot päivitetään 31 päivä joulukuuta 2025 jälkeen, muutoksen käsittelyyn sovelletaan sosiaali- ja terveydenhuollon valvonnasta annetun lain 5 §:ää ja 3 lukua.
2.Laki ikääntyneen väestön toimintakyvyn tukemisesta sekä iäkkäiden sosiaali- ja terveyspalveluista annetun lain muuttamisesta annetun lain voimaantulosäännöksen 4 momentin kumoamisesta
Eduskunnan päätöksen mukaisesti säädetään:
1 §
Tällä lailla kumotaan ikääntyneen väestön toimintakyvyn tukemisesta sekä iäkkäiden sosiaali- ja terveyspalveluista annetun lain muuttamisesta annetun lain (876/2022) voimaantulosäännöksen 4 momentti, sellaisena kuin se on laissa 1046/2023.

Tämä laki tulee voimaan päivänä kuuta 20 .
