Laki kansaneläkelain muuttamisesta
Eduskunnan päätöksen mukaisesti kumotaan kansaneläkelain (568/2007) 8 §:n 3 ja 4 momentti sekä muutetaan 8 §:n 2 momentti, 9 §:n 4 momentti ja 65 §:n 1 momentti seuraavasti:
8 §Asumisedellytys
Lapsikorotukseen ja perhe-eläkkeeseen on oikeus myös muualla kuin Suomessa asuvalla henkilöllä, jos hän asuu valtiossa, jossa sovelletaan sosiaaliturva-asetusta.
9 §Asumisaikavaatimus
Sosiaaliturva-asetusta sovellettaessa henkilön muussa valtiossa täyttyneet vakuutuskaudet otetaan tarvittaessa huomioon laskettaessa 1 ja 3 momentin mukaista asumisaikaa, jos Suomessa asuttua aikaa on vähintään yksi vuosi.
65 §Etuuden keskeyttäminen ulkomaille muuttamisen vuoksi
Jos etuudensaaja muuttaa ulkomaille asumaan, etuuden maksaminen keskeytetään ulkomaille muuttoa seuraavan kuukauden alusta.

Tämä laki tulee voimaan päivänä kuuta 20 .
Suomessa asuvan tällä lailla muutettavan lain 7 §:n 1 kohdassa tarkoitetun sosiaaliturva-asetuksen tai 7 §:n 2 kohdassa tarkoitetun perusasetuksen soveltamisalaan kuuluvan henkilön ennen tämän lain voimaantuloa alkanut kansaneläke lasketaan perusasetuksen 58 artiklan edellyttämällä tavalla eläkkeensaajan hakemuksesta tai, kun eläke tarkistetaan lain voimaantulosta tai myöhäisemmästä ajankohdasta. Jos eläkkeensaaja asuu lain voimaantullessa perusasetusta soveltavassa valtiossa, kansaneläkkeen maksu keskeytetään lain voimaantuloa seuraavan kuukauden alusta. Etuudensaajan palattua Suomeen asumaan aletaan keskeytettyä etuutta maksaa paluuta seuraavan kuukauden alusta. Etuutta maksetaan kuitenkin takautuvasti enintään kuuden kuukauden ajalta paluuilmoituksen tekemisestä. Keskeytetty eläke lakkaa ilman eri päätöstä, jos sitä ei ole kahden vuoden kuluessa keskeyttämisestä lukien vaadittu maksettavaksi.
Sen estämättä, mitä tässä laissa säädetään, Kansaneläkelaitoksen tämän lain voimaantullessa voimassa olleen 65 §:n perusteella antama päätös etuuden maksamisesta vuoden ajan ulkomaille muutosta on voimassa päätöksessä määrätyn ajan.
