Laki vapaasta sivistystyöstä annetun lain muuttamisesta
Eduskunnan päätöksen mukaisesti muutetaan vapaasta sivistystyöstä annetun lain (632/1998) 9 §:n 1 momentti, 10 §:n 1 momentti ja 24 §:n 1 momentti, sellaisina kuin niistä ovat 9 §:n 1 momentti ja 10 §:n 1 momentti laissa 579/2015, sekä lisätään 9 §:ään, sellaisena kuin se on laeissa 579/2015 ja 1487/2016, uusi 4 momentti seuraavasti:
9 §Valtionosuuden määrä
Kansanopiston, kansalaisopiston ja kesäyliopiston ylläpitäjälle myönnetään valtionosuutta 57 prosenttia sekä opintokeskuksen ja liikunnan koulutuskeskuksen ylläpitäjälle 65 prosenttia 8 §:n mukaan lasketusta euromäärästä. Valtionosuutta myönnetään kuitenkin kansanopiston, opintokeskuksen, kansalaisopiston tai kesäyliopiston ylläpitäjälle sata prosenttia 8 §:n mukaan lasketusta euromäärästä opetus- ja kulttuuriministeriön 10 §:n nojalla vahvistamalle määrälle sellaista oppilaitoksen ylläpitäjän järjestämää koulutusta, joka on hyväksytty kotoutumisen edistämisestä annetun lain (1386/2010) 11 §:ssä tarkoitettuun opiskelijan kotoutumissuunnitelmaan. Edellä 2 §:n 8 momentissa tarkoitetun oppilaitoksen ylläpitäjälle myönnetään valtionosuutta 57 prosenttia 8 §:n mukaan lasketusta euromäärästä.
Opetus- ja kulttuuriministeriö voi hakemuksesta myöntää valtionosuutta enemmän kuin 1 momentissa säädetään 4 §:n nojalla myönnetyn ylläpitämisluvan saaneelle kansanopiston ylläpitäjälle, jos oppilaitoksen luvan mukainen pääasiallinen koulutustehtävä on vaikeasti vammaisille järjestettävä koulutus. Valtionosuuden määrä voi olla enintään 80 prosenttia 8 §:n mukaan lasketusta euromäärästä. Opetus- ja kulttuuriministeriö voi ylläpitäjää kuultuaan muuttaa päätöstä, jos kansanopiston järjestämässä koulutuksessa tapahtuneet olennaiset muutokset sitä edellyttävät.
10 §Valtionosuuden laskemisessa käytettävien suoritteiden määrän vahvistaminen
Opetus- ja kulttuuriministeriö vahvistaa vuosittain valtion talousarvion rajoissa valtionosuuden laskemisen perusteena käytettävän opiskelijaviikkojen, opiskelijavuorokausien, opiskelijapäivien sekä opetustuntien määrän. Opetus- ja kulttuuriministeriö vahvistaa lisäksi vuosittain valtion talousarvion rajoissa niiden opiskelijaviikkojen ja opetustuntien määrän edellä mainituista opiskelijaviikoista ja opetustunneista, joihin 9 §:n 1 momentin mukaisesti myönnetään sadan prosentin valtionosuus. Yhdistetyn oppilaitoksen osalta suoritteiden määrät vahvistetaan erikseen kullekin oppilaitosmuodolle.
24 §Opiskelijoilta perittävät maksut
Opiskelijoilta voidaan periä opetuksesta kohtuullisia maksuja. Maksua ei kuitenkaan peritä kansanopiston, opintokeskuksen, kansalaisopiston tai kesäyliopiston järjestämästä opetuksesta siltä osin, kuin se on hyväksytty kotoutumisen edistämisestä annetun lain 11 §:ssä tarkoitettuun opiskelijan kotoutumissuunnitelmaan.
