Laki maataloustuotteiden markkinajärjestelystä annetun lain muuttamisesta
Eduskunnan päätöksen mukaisesti kumotaan maataloustuotteiden markkinajärjestelystä annetun lain (999/2012) 12 c §:n 2 momentti sellaisena kuin se on laissa 1194/2013, muutetaan 2 §:n 2 momentti sellaisena kuin se on laissa 1194/2013, sekä lisätään 12 b §:ään, sellaisena kuin se on laissa 1194/2013 uusi 3 momentti ja lakiin uusi 12 g § seuraavasti:
2 §Suhde muuhun lainsäädäntöön
Tämän lain nojalla hyväksyttyjen tuottajaorganisaatioiden sopimusten, päätösten ja menettelytapojen hyväksyttävyydestä, hyväksyttävyyden arvioinnista ja näissä asioissa toimivaltaisista viranomaisista säädetään maataloustuotteiden yhteisestä markkinajärjestelystä ja neuvoston asetusten (ETY) N:o 992/72, (ETY) N:o 234/79, (EY) N:o 1037/2001 ja (EY) N:o 1234/2007 kumoamisesta annetussa Euroopan parlamentin ja neuvoston asetuksessa (EU) N:o 1308/2013, jäljempänä markkinajärjestelyasetus , ja kilpailulaissa (948/2011).
12 b §Tuottajaorganisaation hyväksymisen yleiset edellytykset
Tuottajaorganisaatio voi ulkoistaa toimintojaan EU:n markkinajärjestelylainsäädännössä säädetyin edellytyksin. Valtioneuvoston asetuksella voidaan antaa ulkoistamista koskevia tarkempia säännöksiä.
12 g §Naudanliha- ja peltokasvialan tuottajaorganisaatiot
Tuottajaorganisaatioksi voidaan hyväksyä myös markkinajärjestelyasetuksessa tarkoitettu naudanliha-alan tuottajaorganisaatio ja asetuksen 171 artiklassa tarkoitettujen tiettyjen peltokasvialan tuotteiden tuottajaorganisaatio. Hyväksymisen edellytyksiin sovelletaan, mitä 12 b §:ssä säädetään.
Naudanliha-alan ja peltokasvialan tuottajaorganisaation velvollisuudesta ilmoittaa sopimusneuvottelujen kohteena olevan tuotannon määrästä säädetään EU:n markkinajärjestelylainsäädännössä. Ilmoitukset on tehtävä Maaseutuvirastolle.
§
Tämä laki tulee voimaan päivänä kuuta 20 .
