Laki uusiutuvilla energialähteillä tuotetun sähkön tuotantotuesta annetun lain muuttamisesta
Eduskunnan päätöksen mukaisesti kumotaan uusiutuvilla energialähteillä tuotetun sähkön tuotantotuesta annetun lain (1396/2010) 13 § ja 17 c §:n 1 momentti, sellaisena kuin niistä on 17 c §:n 1 momentti laissa 434/2014, ja muutetaan 6 §:n 3 momentti, 9 §:n 1 momentin johdantokappale ja 2 momentti, 14 §:n 2 momentti, 15 §:n 1 momentti sekä 17 b §:n 2 ja 3 momentti, sellaisina kuin niistä ovat 6 §:n 3 momentti, 9 §:n 2 momentti sekä 17 b §:n 2 ja 3 momentti laissa 434/2014, seuraavasti:
6 §Syöttötariffijärjestelmä
Etuoikeus saada biokaasuvoimala ja puupolttoainevoimala hyväksytyksi syöttötariffijärjestelmään on sillä sähkön tuottajalla, joka on ensimmäisenä hakenut hyväksymistä 14 §:ssä säädetyllä tavalla. Etuoikeudesta saada tuulivoimalalle kiintiö vahvistetuksi syöttötariffijärjestelmän tämän pykälän 2 momentin 2 kohdan mukaisesta enimmäismäärästä (tuulivoimaloiden kokonaiskapasiteetti ) säädetään 17 a §:ssä.
9 §Tuulivoimalan hyväksymisen erityiset edellytykset
Tuulivoimala voidaan hyväksyä syöttötariffijärjestelmään vain, jos sille on päätöksellä vahvistettu kiintiö tuulivoimaloiden kokonaiskapasiteetista sekä:
Merituulivoimalan kokeiluhanke, jonka investointia varten on myönnetty valtiontukea, hyväksytään syöttötariffijärjestelmään.
14 §Hakemus
Hakemus on tehtävä ennen kuin tuulivoimala, biokaasuvoimala ja siihen biokaasua tuottava biokaasulaitos tai puupolttoainevoimala otetaan kaupalliseen käyttöön sekä tuulivoimalan osalta, merituulivoimalan kokeiluhaketta lukuun ottamatta, lisäksi ennen kuin kiintiöpäätöksen voimassaolo päättyy. Metsähakevoimalan hyväksymistä koskeva hakemus voidaan tehdä myös metsähakevoimalan kaupalliseen käyttöön ottamisen jälkeen.
15 §Hyväksymispäätös
Energiavirasto hyväksyy voimalaitoksen syöttötariffijärjestelmään, jos hakemuksessa on osoitettu, että tässä laissa säädetyt edellytykset täyttyvät ja että hyväksymiselle ei ole tässä laissa säädettyä estettä.
17 b §Tuulivoimalaa koskeva kiintiöpäätös
Energiaviraston on hylättävä kiintiöpäätöstä koskeva hakemus, jos on painavia perusteita epäillä, että tuulivoimalan tuuliturbiinien suuren määrän takia tai muista syistä sähkön tuottajalla ei ole edellytyksiä tai ilmeisesti tarkoitusta tehdä hakemusta syöttötariffijärjestelmään hyväksymistä varten. Energiaviraston on myös hylättävä kiintiöpäätöstä koskevat hakemukset sen jälkeen, kun tuulivoimaloiden kokonaiskapasiteetti syöttötariffijärjestelmään hyväksymistä koskevien päätösten ja tehtyjen kiintiöpäätösten sekä 9 §:n 2 momentissa tarkoitetun merituulivoimalan kokeiluhankkeen perusteella on ensimmäisen kerran tullut täyteen.
Kiintiöpäätös on voimassa kaksi vuotta päätöksen lainvoimaiseksi tulosta, kuitenkin enintään 1 päivään marraskuuta 2017.
§
Tämä laki tulee voimaan päivä kuuta 20 .
Tuulivoimalan syöttötariffijärjestelmään hyväksymistä koskevaan hakemukseen, joka on vireillä tämän lain tullessa voimaan, sovelletaan tämän lain voimaan tullessa voimassa olleita säännöksiä.
