Laki opetus- ja kulttuuritoimen rahoituksesta annetun lain muuttamisesta
Eduskunnan päätöksen mukaisesti lisätään opetus- ja kulttuuritoimen rahoituksesta annetun lain (1705/2009) 1 §:ään, sellaisena kuin se on laeissa 1410/2014, 532/2017, 957/2017, 716/2018, 315/2019, 1083/2020, 1220/2020, 1114/2021 ja 489/2022, uusi 7 momentti sekä lakiin siitä lailla 532/2017 kumotun 46 §:n tilalle uusi 46 § seuraavasti:
1 §Soveltamisala
Tässä laissa säädetään lisäksi erityisavustuksen myöntämisestä tilapäistä suojelua hakevien tai saavien, kansainvälistä suojelua hakevien taikka ilman oleskeluoikeutta olevien lasten varhaiskasvatuksen järjestämiseen.
46 §Tilapäistä suojelua hakevien tai saavien, kansainvälistä suojelua hakevien taikka ilman oleskeluoikeutta olevien lasten varhaiskasvatukseen myönnettävä erityisavustus
Kunnalle tai kuntayhtymälle voidaan myöntää erityisavustusta sellaisten tilapäistä suojelua hakevien tai saavien, kansainvälistä suojelua hakevien taikka ilman oleskeluoikeutta olevien lasten varhaiskasvatuslain mukaisen varhaiskasvatuksen järjestämiseen, joilla ei ole kotikuntalain (201/1994) mukaista kotikuntaa, valtion talousarviossa tarkoitukseen osoitetun määrärahan puitteissa. Kunta tai kuntayhtymä voi sisällyttää hakemukseen myös yksityistä varhaiskasvatusta. Erityisavustusta ei myönnetä avoimeen varhaiskasvatustoimintaan.
Edellä 1 momentissa tarkoitetaan kansainvälistä suojelua hakevalla lapsella ulkomaalaista lasta, joka on hakenut kansainvälistä suojelua ulkomaalaislain (301/2004) 95 §:n mukaisesti ja tilapäistä suojelua hakevalla tai saavalla lapsella ulkomaalaislain 109 §:ssä tarkoitettua suojelua hakenutta tai saanutta ulkomaalaista lasta. Ilman oleskeluoikeutta olevalla lapsella tarkoitetaan lasta, jonka oleskeluoikeus Suomessa on ulkomaalaislain 40 §:n mukaisesti päättynyt.
Tässä pykälässä tarkoitetun erityisavustuksen myöntämisperusteista ja käyttökohteista voidaan antaa tarkempia säännöksiä valtioneuvoston asetuksella.
Tässä pykälässä tarkoitettu erityisavustus voi kattaa valtionavustuksen kohteena olevasta toiminnasta aiheutuvien laskennallisten kokonaiskustannusten täyden määrän.
§
Tämä laki tulee voimaan päivänä 20 .
