1.Laki terveydenhuoltolain muuttamisesta
Eduskunnan päätöksen mukaisesti muutetaan terveydenhuoltolain (1326/2010) 14 § ja 24 §:n 1 momentti, sellaisina kuin ne ovat, 14 § laissa 581/2022 ja 24 §:n 1 momentti osaksi laissa 581/2022, ja lisätään 13 §:ään, sellaisena kuin se on laissa 581/2022, uusi 4 momentti, seuraavasti:
13 §Terveysneuvonta ja terveystarkastukset
Tarpeellisten terveystarkastusten järjestämiseksi on määritettävä järjestettävien terveystarkastusten kohderyhmät.
14 §Seulonnat
Hyvinvointialueen on järjestettävä alueellaan 23§:n nojalla annettujen säännösten mukaisen valtakunnallisen seulontaohjelman mukaiset seulonnat. Hyvinvointialue voi lisäksi järjestää seulontoja ja terveystarkastuksia tietyn taudin tai sen esiasteen toteamiseksi tai taudin aiheuttajan löytämiseksi. Seulontojen järjestämiseksi on määritettävä kohderyhmät ottaen huomioon valtakunnallisen seulontaohjelman mukaiset seulonnat.
24 §Sairaanhoito
Hyvinvointialueen on järjestettävä alueensa asukkaiden sairaanhoitopalvelut. Sairaanhoitopalveluihin sisältyvät:
1) sairauksien tutkimus, lääketieteellinen tai hammaslääketieteellinen taudinmääritys, hoito, hoidon seuranta, hoitosuunnitelman mukaiset pitkäaikaisen sairauden hoitoon tarvittavat hoitotarvikkeet sekä tarpeellinen lääkinnällinen kuntoutus;
2) sairauksien ehkäiseminen, parantaminen ja kärsimysten lievittäminen;
3) ohjaus, jolla tuetaan potilaan hoitoon sitoutumista ja omahoitoa;
4) erityistä tukea, tutkimusta ja hoitoa tarvitsevan potilaan terveysongelmien varhainen tunnistaminen, hoito ja hoidon seuranta sekä jatkohoitoon ohjaaminen.
§
Tämä laki tulee voimaan päivänä kuuta 20 .
2.Laki sosiaali- ja terveydenhuollon asiakastietojen käsittelystä annetun lain 9 §:n muuttamisesta
Eduskunnan päätöksen mukaisesti lisätään sosiaali- ja terveydenhuollon asiakastietojen käsittelystä (703/2023) annetun lain 9 §:ään uusi 2 momentti, jolloin nykyinen 2 ja 3 momentti siirtyvät 3 ja 4 momentiksi, seuraavasti:
9 §Käyttöoikeus asiakastietoon
Lisäksi terveydenhuoltolain 13 §:ssä tarkoitettua terveystarkastuksen kohderyhmän määrittämistä, 14 §:ssä tarkoitettua seulonnan kohderyhmän määrittämistä sekä 24 §:n 1 momentin kohdassa tarkoitettua hoidon seurantaa ja 4 kohdassa tarkoitettua terveysongelmien varhaista tunnistamista ja hoidon seurantaa hoitavat ammattihenkilöt ovat oikeutettuja käsittelemään kyseisissä tehtävissään välttämättömiä terveydenhuollon järjestäjän omassa rekisterissä olevia potilastietoja. Uudenmaan maakunnan alueen kunkin hyvinvointialueen tai Helsingin kaupungin tässä momentissa tarkoitettuja tehtäviä hoitavat ammattihenkilöt saavat lisäksi salassapitosäännösten estämättä käsitellä HUS-yhtymän rekisterissä olevia alueensa henkilöiden tässä momentissa tarkoitettuja potilastietoja.

Tämä laki tulee voimaan päivänä kuuta 20 .
