Laki työaikalain muuttamisesta

Eduskunnan päätöksen mukaisesti muutetaan työaikalain (872/2019) 34 §:n 5 momentti, 39 §:n 2 momentti ja 44 §:n 1 momentti seuraavasti:

34 §Poikkeaminen työehtosopimuksella

Valtakunnallisessa työehtosopimuksessa saadaan lisäksi sopia 5 §:ssä säädettyjen työajan rajoitusten ja 25 §:n vuorokausilepoa koskevien säännösten estämättä poikkeuksellisesta säännöllisestä työajasta työssä, jota tehdään vain aika ajoin sen vuorokautisen työajan kuluessa, jona työntekijän on oltava valmiina työhön. Tällöin työntekijälle on turvattava 25 §:ssä säädettyjä lepoaikoja vastaava korvaava lepoaika välittömästi työvuoron päättymisen jälkeen.

39 §Poikkeuslupa

Jos aluehallintovirasto on myöntänyt työnantajalle 1 momentissa tarkoitetun luvan määräaikaisena eivätkä olosuhteet ole myöntämisen jälkeen olennaisesti muuttuneet, työnantaja ja 36 §:n 2 momentissa tarkoitettu työntekijöiden edustaja voivat sopia aluehallintoviraston myöntämän luvan tai vapautuksen jatkamisesta.

44 §Työaikarikkomus

Työnantaja tai tämän edustaja, joka tahallaan tai huolimattomuudesta rikkoo 18 §:n enimmäistyöaikaa, 19 §:n hätätyötä, 25–27 §:n vähimmäislepoaikoja tai 30 §:n työvuoroluettelon laatimisvelvollisuutta koskevia säännöksiä, on tuomittava työaikarikkomuksesta sakkoon.

Tämä laki tulee voimaan päivänä kuuta 20 .
