Laki vieraslajeista aiheutuvien riskien hallinnasta annetun lain muuttamisesta
Eduskunnan päätöksen mukaisesti muutetaan vieraslajeista aiheutuvien riskien hallinnasta annetun lain (1709/2015) 3 §:n 2 momentin 5 kohta, 11 §:n 3 momentti, 14 §:n 5 momentti, 16 §:n 3 momentti ja 19 §, sellaisena kuin niistä on 16 §:n 3 momentti laissa 682/2019, seuraavasti:
3 §Vieraslajin ympäristöön päästämisen kielto
Mitä 1 momentissa säädetään, ei koske:
5) vieraslajina pidettävän makroeliön käyttöä biologisessa torjunnassa tai pölytyksessä, milloin se kasvinterveyslain (1110/2019) 8 ja 9 §:n nojalla on sallittu.
11 §Kansallisesti merkitykselliset haitalliset vieraslajit
Valtioneuvoston asetuksella säädetään tarkemmin, mitkä lajit tai mihin lajiryhmiin kuuluvat lajit ovat kansallisesti merkityksellisiä haitallisia vieraslajeja. Valtioneuvoston asetuksella voidaan säätää, että haitalliseen vieraslajiin tai sen tiettyyn käyttötarkoitukseen ei sovelleta 2 momentin 2 kohdassa säädettyä kieltoa taikka 4 tai 5 §:ssä säädettyä velvoitetta jossakin tai missään osassa maata, jos kiellon tai velvoitteen soveltamista ei voida pitää perusteltuna lajista aiheutuvan 1 momentissa tarkoitetun vahingon tai vaaran vähentämiseksi. Valtioneuvoston asetuksella voidaan säätää myös, että 2 momentin 2 kohdassa tarkoitettua kieltoa ei asetuksella säädettävän siirtymäajan kuluessa sovelleta lajin yksilöihin, jotka on saatu haltuun ennen asetuksen voimaantuloa. Asetuksella säädettävä siirtymäaika voi olla enintään kolme vuotta asetuksen voimaantulosta. Jos 2 momentin 2 kohdassa tarkoitettu kielto koskee eläinlajia, asetuksella voidaan säätää, että omistaja saa pitää eläimen hallussaan sen luonnolliseen kuolemaan saakka.
14 §Tiedonsaanti- ja tarkastusoikeus
Tullin toimivaltuuksista säädetään tullilaissa (304/2016).
16 §Ympäristöön päässeen lintu- tai nisäkäslajin pyydystäminen ja tappaminen
Tässä pykälässä tarkoitetun nisäkkään saa ampua sen pyydystämisessä käytettyyn loukkuun poiketen siitä, mitä metsästyslain 25 §:n 1 momentissa säädetään. Tässä pykälässä tarkoitetun nisäkkään saa myös jäljittää miehittämättömällä ilma-aluksella poiketen siitä, mitä metsästyslain 32 §:n 1 momentissa säädetään.
19 §Muutoksenhaku
Muutoksenhausta hallintotuomioistuimeen säädetään oikeudenkäynnistä hallintoasioissa annetussa laissa (808/2019).
Muutoksenhausta Tullin päätökseen säädetään kuitenkin tullilaissa.
§
Tämä laki tulee voimaan päivänä kuuta 20 .
