Laki koulumatkatukilain muuttamisesta
Eduskunnan päätöksen mukaisesti muutetaan koulumatkatukilain (48/1997) 2 ja 3 §, 4 §:n 2 ja 4 momentti sekä 5 §, sellaisina kuin ne ovat laissa 1223/2020, seuraavasti:
2 §Koulumatkatukeen oikeuttava koulutus
Koulumatkatukeen on oikeutettu Suomessa asuva, oppivelvollisuuslain (1214/2020) 16 §:n nojalla maksuttomaan koulutukseen oikeutettu opiskelija, joka opiskelee Suomessa päätoimisesti mainitun lain 4 §:ssä tarkoitetussa koulutuksessa.
Opiskelun päätoimisuudesta säädetään opintotukilaissa (65/1994).
Koulumatkatukeen ei kuitenkaan ole oikeutettu etä- tai yksityisopetuksena tai maksullisena palvelutoimintana järjestettävän koulutuksen tai oppisopimuskoulutuksen opiskelija.
3 §Koulumatkatuen myöntämisen edellytykset
Koulumatkatuen myöntämisen edellytyksenä on pitkä koulumatka ja soveltuva matkustustapa, joita määriteltäessä otetaan huomioon matkasta kalenterikuukausittain aiheutuvat säännölliset kustannukset, opiskelijan mahdollisuus käyttää julkista liikennettä sekä opiskelun yhtäjaksoisuus.
Koulumatkatukea myönnetään, jos opiskelijan:
1) yhdensuuntaisen koulumatkan pituus on vähintään 7 kilometriä; sekä
2) käyttämä matkustustapa on joukkoliikenne tai koulutuksen järjestäjän järjestämä koulukuljetus taikka 4 a §:ssä säädettyjen edellytysten täyttyessä muu soveltuva oma matkustustapa.
Koulumatkatuen myöntämisen edellytyksenä on lisäksi, että opiskelijalla on vähintään 10 koulumatkatukeen oikeuttavaa päivää kalenterikuukaudessa.
4 §Matkakustannusten määräytyminen ja laskeminen
Opiskelijan käyttäessä koulumatkaansa liikenteen palveluista annetun lain (320/2017) 181 §:ssä tarkoitettujen toimivaltaisten viranomaisten yhteistä lippu- ja maksujärjestelmää käyttävää joukkoliikennettä matkakustannukset määräytyvät sen estämättä, mitä tämän pykälän 1 momentissa säädetään, sen matkan pituuden mukaan, jonka opiskelija kulkee tätä kuljetusta käyttäen. Matkakustannukset määräytyvät kuitenkin halvimman opiskelijalle puolta kuukautta tai kuukautta vastaavalle ajalle tarkoitetun lipputuotteen hinnan mukaan, kun opiskelijan koulumatkan tai yksittäisen matkaosuuden pituus on alle 10 kilometriä.
Alle viiden kilometrin erillisestä matkaosuudesta aiheutuvia kustannuksia ei korvata erikseen. Matkaosuuksista aiheutuvat kustannukset korvataan kuitenkin silloin, jos 3 §:n 2 momentin 1 kohdassa tarkoitettuun yhdensuuntaiseen koulumatkaan sisältyy erillisiä alle viiden kilometrin matkaosuuksia, jotka ovat yhteensä vähintään viisi kilometriä.
5 §Koulumatkatuen määrä
Koulumatkatukena korvataan 4 §:ssä säädetyllä tavalla määritellyt koulumatkan kustannukset. Jos tuki kuitenkin myönnetään 4 a §:n mukaisesti oman matkustustavan perusteella tai jos matkakustannukset aiheutuvat 4 §:n 6 momentissa tarkoitetuista useista erillisistä yhteensä vähintään viiden kilometrin matkaosuuksista, tuki on 70 prosenttia 4 §:n 5 momentin nojalla annettujen säännösten perusteella määräytyvästä tuesta.

Tämä laki tulee voimaan päivänä kuuta 20 .
