Laki arvonlisäverolain väliaikaisesta muuttamisesta
Eduskunnan päätöksen mukaisesti muutetaan väliaikaisesti arvonlisäverolain (1501/1993) 85 a §:n 1 momentin 11 kohta, sellaisena kuin se on laissa 345/2019, ja lisätään 59 §:ään, sellaisena kuin se on osaksi laeissa 376/1994, 1218/1994, 1486/1994 ja 1119/2018, siitä lailla 1119/2018 kumotun 5 kohdan tilalle väliaikaisesti uusi 5 kohta, 85 a §:n 1 momenttiin, sellaisena kuin se on laeissa 345/2019 ja 623/2021, väliaikaisesti uusi 12 kohta, 131 §:n 1 momenttiin, sellaisena kuin se on laeissa 505/2014, 507/2014 ja 1113/2021, väliaikaisesti uusi 1 b kohta ja 209 b §:n 1 momenttiin, sellaisena kuin se on laeissa 399/2012 ja 1113/2021, väliaikaisesti uusi 2 b kohta seuraavasti:
59 §
Veroa ei suoriteta seuraavien tavaroiden ja palvelujen myynnistä:
5) henkilökuljetukset;
85 a §
Seuraavien palvelujen myynnistä sekä seuraavien tavaroiden myynnistä, yhteisöhankinnasta, siirrosta varastointimenettelystä ja maahantuonnista suoritettava vero on 10 prosenttia veron perusteesta:
11) esiintyvän taiteilijan tai muun julkisen esiintyjän ja urheilijan esityksen myynnistä saatava 45 §:n 1 momentin 1 ja 2 kohdassa tarkoitettu palkkio tai korvaus, kun liiketoiminnan harjoittaja on hakeutunut tästä toiminnasta verovelvolliseksi;

131 §
Elinkeinonharjoittajalla on oikeus saada palautuksena tavaran tai palvelun hankintaan sisältyvä vero, jos hankinta liittyy:
1 b) toimintaan, josta ei suoriteta veroa 59 §:n 5 kohdan perusteella;
209 b §
Myyjän on annettava ostajalle lasku, jos ostajana on elinkeinonharjoittaja tai oikeushenkilö, joka ei ole elinkeinonharjoittaja:
2 b) myynnistä, joka on veroton 59 §:n 5 kohdan nojalla;

Tämä laki tulee voimaan 1 päivänä joulukuuta 2022 ja on voimassa 30 päivään huhtikuuta 2023. Lain 59 §:n 5 kohta, 131 §:n 1 momentin 1 b kohta ja 209 b §:n 1 momentin 2 b kohta tulevat kuitenkin voimaan vasta 1 päivänä tammikuuta 2023.
Tätä lakia sovelletaan, kun veron suorittamisvelvollisuus syntyy lain voimassaoloaikana.
Mitä arvonlisäverolain (1501/1993) 85 a §:n 1 momentin 1 kohdassa säädetään, ei sovelleta tämän lain 59 §:n 5 kohdan ollessa voimassa.
