Laki jätelain muuttamisesta
Eduskunnan päätöksen mukaisesti muutetaan jätelain (646/2011) 32 §:n 1 momentti ja 42 §:n 1 momentti, sellaisena kuin niistä on 42 §:n 1 momentti laissa 195/2012, sekä lisätään lakiin uusi 145 a § seuraavasti:
32 §Kunnan velvollisuus järjestää jätehuolto
Kunnan on järjestettävä seuraavien, muiden kuin vaarallisten jätteiden jätehuolto:
1) vakinaisessa asunnossa, vapaa-ajan asunnossa, asuntolassa ja muussa asumisessa syntyvä jäte, mukaan lukien sako- ja umpikaivoliete;
2) kunnan hallinto- ja palvelutoiminnassa syntyvä yhdyskuntajäte;
3) liikehuoneistossa syntyvä yhdyskuntajäte, joka kerätään kiinteistöllä yhdessä 1 ja 2 kohdassa tarkoitetun jätteen kanssa;
4) muu yhdyskuntajäte, joka kerätään yhdessä 1─3 kohdassa tarkoitetun jätteen kanssa alueellisessa putkikeräys- tai muussa vastaavassa keräysjärjestelmässä.
42 §Poikkeus velvollisuudesta luovuttaa jäte kunnan järjestämään jätehuoltoon
Kunta voi jätteen haltijan hakemuksesta päättää, että 32 §:n 1 momentin 2 kohdassa tarkoitetun jätteen jätehuolto 41 §:n 1 momentista poiketen voidaan järjestää 4 luvun mukaisesti, jos tämä on kokonaisuutena arvioiden perusteltua kiinteistön jätehuollon järjestämiseksi ja johtaa etusijajärjestyksen toimeenpanon kannalta vähintään yhtä hyvään lopputulokseen eikä siitä aiheudu vaaraa tai haittaa ympäristölle eikä terveydelle. Päätös tehdään määräajaksi enintään viideksi vuodeksi.
145 a §Sidos- ja hankintayksiköitä koskevat erityiset säännökset
Poiketen siitä, mitä julkisista hankinnoista ja käyttöoikeussopimuksista annetun lain (1397/2016) 15 §:n 1 momentissa ja 16 §:n 1 momentissa säädetään sidosyksiköihin ja hankintayksiköihin sovellettavista prosenttiosuuksista ja euromääräisistä rajoituksista, 31 päivään joulukuuta 2029 saakka kunnan jätehuollon toimialalla toimiviin sidosyksiköihin ja hankintayksiköihin sovellettava prosenttiosuus on kymmenen eikä niihin sovelleta 500 000 euron rajoitusta.
Edellä 1 momentissa tarkoitettu kunnan jätehuollon toimialalla toimiviin sidosyksiköihin ja hankintayksiköihin sovellettava prosenttiosuus on 1 päivästä tammikuuta 2030 viisi eikä niihin sovelleta 500 000 euron rajoitusta.
Muutoin noudatetaan julkisista hankinnoista ja käyttöoikeussopimuksista annettua lakia.
§
Tämä laki tulee voimaan päivänä kuuta 20 .
Kunta, joka on järjestänyt ennen tämän lain voimaantuloa voimassa olleiden säännösten nojalla vastuulleen kuuluneen muun kuin tämän lain 32 §:n 1 momentissa tarkoitetun jätteen kuljetuksen 36 §:n mukaisesti, voi jatkaa järjestelyä asianomaisen yhteisön tai yrityksen kanssa tehdyn sopimuksen voimassaolon ajan, kuitenkin enintään kolmen vuoden ajan tämän lain voimaantulosta. Kunnan näin menetellessä asianomaista jätteen haltijaa eivät tuona aikana koske 28 §:ssä säädetyt velvollisuudet jätehuollon järjestämisessä.
