What is proposed
A provision would be added to Section 10 of the Constitution allowing statutory restrictions to be laid down on the secrecy of communications where necessary to obtain intelligence on military activities or other activities that seriously threaten national security. At the same time, the wording of the provision 'in the investigation of crimes' would be updated to 'in combating crime' to reflect established application practice.
What it means
The amendment gives the legislature the power to enact new intelligence powers for authorities to monitor telecommunications and messages even when there is not yet any concrete suspicion of an offence. The regulation affects all communications users and security authorities, but sets a high threshold for the activity and does not allow general mass surveillance. The intelligence acts and oversight systems enacted following the amendment will later require additional resources for authorities and courts.
How Parliament voted
The act ultimately passed without a vote: no MP proposed rejecting it in the final reading. The only vote concerned a detail of the act.

Key points of the debate
Parliament debated amending the Constitution to enable restrictions on the secrecy of confidential communications in order to protect national security and enact new intelligence legislation. Broad parliamentary consensus prevailed on the content of the proposal and the need to update intelligence powers. Controversy was sparked above all by amending the Constitution through an exceptional urgent procedure, as well as the adequacy of privacy protection and the oversight of intelligence gathering.
- Should the Constitution be amended exceptionally through an urgent procedure without intervening parliamentary elections?
- How should citizens' secrecy of communications and independent oversight of intelligence activities be ensured?
- National Coalition PartyIn favour
The group supported amending the Constitution and enacting it urgently, as the changed international security environment and new threats required up-to-date powers for authorities.
”Perustuslaille ja valtiosäännölle ylipäätään on tietysti ominaista määrätynlainen pysyvyys ja suhteellinen muuttumattomuus. Tämä ei kuitenkaan ole ehdotonta.”
— Wille Rydman - Centre PartyIn favour
The group firmly backed the legislative amendment and considered it necessary to ensure authorities' access to information and Finland's security.
”Tiedustelulakipaketti on välttämätön maamme turvallisuuden vahvistamiseksi.”
— Seppo Kääriäinen - Blue ReformIn favour
The group considered the legislative package necessary to protect national security and supported amending the Constitution through the urgent procedure due to rapid changes in the security environment.
”Tiedustelulainsäädännön luomiselle ja perustuslain muuttamiselle kiireellisesti on olemassa nyt erityisen painavat perusteet.”
— Vesa-Matti Saarakkala - Finns PartyIn favour
The group supported the proposal and bringing the acts into force on an expedited timetable so that authorities can combat terrorism and other new security threats.
”Perussuomalaiset suhtautuvat tiedustelulakien uudistamiseen myönteisesti. Pidämme tarpeellisena, että lainsäädäntö saatetaan vastaamaan Suomen turvallisuustilanteeseen kohdistuvia muutoksia.”
— Juho Eerola - Social DemocratsIn favour
The group supported reforming intelligence legislation and amending the Constitution, but stressed the necessity of strict parliamentary and independent oversight and safeguarding fundamental rights.
”Suomi tarvitsee uuden, ajantasaisen tiedustelulainsäädännön.”
— Mika Kari - GreensIn favour with reservations
The group recognised the need to create rules for intelligence, but was reserved about amending the Constitution urgently and emphasised the protection of the secrecy of communications and strong oversight.
”Perustuslain muuttaminen ei ole arkipäiväinen asia, eikä voi kylliksi korostaa sitä, miten poikkeuksellista on esittää perustuslain muutos kiireellisenä.”
— Pekka Haavisto - Left AllianceAgainst
The group opposed amending the Constitution through the urgent procedure and stressed that in matters weakening citizens' fundamental rights, the decision should wait until after elections.
”Perustuslain muuttamiselle tulee olla aina hyvä peruste ja erityinen peruste pitää olla silloin, kun se halutaan tehdä kiireellisessä järjestyksessä.”
— Markus Mustajärvi - Swedish People's PartyIn favour
The group supported the bill because the security environment requires updating authorities' intelligence capabilities and national stability to meet modern requirements.
”Tiedustelulakien tehtävä on hyvin selkeä: luoda vakautta tähän yhteiskuntaan ja antaa virkavallalle edellytykset suojella tätä kansaa ja maata.”

The group supported amending the Constitution swiftly and through the urgent procedure to strengthen national security.
”Tiedustelulait tulee saattaa voimaan nopealla aikataululla. Kristillisdemokraattinen eduskuntaryhmä kannattaa hallituksen esittämää perustuslain muuttamista kiireellisesti.”
— Päivi Räsänen
