1.Laki ulkomaalaislain muuttamisesta
Eduskunnan päätöksen mukaisesti muutetaan ulkomaalaislain (301/2004) 35 §:n 3 momentti, 109 §, 110 §:n 1 momentti ja 113 §:n 2 momentti, sellaisena kuin niistä on 35 §:n 3 momentti laissa 472/2024, sekä lisätään 110 §:ään uusi 4 momentti seuraavasti:
35 §Tunnistaminen oleskeluluvan myöntämisen edellytyksenä
Jos hakijalle on myönnetty määräaikainen oleskelulupa 87 tai 88 §:n perusteella, pysyvä oleskelulupa voidaan näillä edellytyksillä myöntää voimassa olevan matkustusasiakirjan puuttumisesta huolimatta.
109 §Tilapäinen suojelu
Tilapäistä suojelua voidaan antaa kansainvälisen suojelun tarpeessa olevalle ulkomaalaiselle, jonka turvallinen paluu kotimaahansa tai pysyvään asuinmaahansa ei ole mahdollinen sen vuoksi, että maasta tai sen lähialueilta on tapahtunut ihmisten joukkopako aseellisen selkkauksen tai muun väkivaltatilanteen taikka ympäristökatastrofin vuoksi.
Valtioneuvosto päättää yleisistunnossa väestöryhmästä, jolle tilapäistä suojelua voidaan antaa, sekä ajanjaksosta, jolloin oleskelulupia tilapäisen suojelun perusteella voidaan myöntää. Valtioneuvosto voi muuttaa päätöstään, jos tarvetta tilapäiselle suojelulle ei enää ole.
110 §Oleskeluluvan myöntäminen tilapäisen suojelun perusteella
Tilapäisen suojelun tarpeessa olevalle ulkomaalaiselle myönnetään tilapäinen oleskelulupa. Oleskelulupa on voimassa siihen asti, kuin kulloinkin sovellettava 109 §:n 2 momentissa tarkoitettu valtioneuvoston päätös on voimassa.
Oleskeluluvan osoitukseksi annettu oleskelulupakortti on voimassa sen ajan, kuin oleskelulupa on voimassa. Voimassa olevan oleskeluluvan osoitukseksi annetaan hakemuksesta uusi oleskelulupakortti. Oleskelulupakorttia haetaan Maahanmuuttovirastolta.
113 §Jatkuvan oleskeluluvan myöntäminen
Ulkomaalaiselle, jolle on myönnetty oleskelulupa 112 §:n 1 momentin 2 kohdan nojalla, myönnetään kolmen vuoden yhtäjaksoisen maassa oleskelun jälkeen jatkuva oleskelulupa, jos perusteet luvan myöntämiselle ovat edelleen olemassa.

Tämä laki tulee voimaan päivänä 20 .
2.Laki ulkomaalaislain väliaikaisesta muuttamisesta annetun lain voimaantulosäännöksen muuttamisesta
Eduskunnan päätöksen mukaisesti lisätään ulkomaalaislain väliaikaisesta muuttamisesta annetun lain (1364/2022) voimaantulosäännökseen uusi 2 momentti seuraavasti:
§
Tämän lain 110 a §:n nojalla myönnetyt ja jatketut oleskeluluvat jäävät lain voimassaolon päättyessä voimaan siihen asti, kuin ne on myönnetty tai niitä on jatkettu. Siltä osin kuin tilapäisen suojelun antaminen perustuu tilapäisen suojelun antamisesta Ukrainan tilanteeseen vastaamiseksi annetun valtioneuvoston päätöksen (149/2022) 3 kohtaan, oleskelulupien voimassaolo kuitenkin päättyy 31 päivänä maaliskuuta 2025.
§
Tämä laki tulee voimaan päivänä kuuta 20 .
