Laki jätelain muuttamisesta
Eduskunnan päätöksen mukaisesti muutetaan jätelain (646/2011) 145 a §, sellaisena kuin se on laissa 445/2018, sekä lisätään lakiin uusi 32 a § seuraavasti:
32 a §Yhdyskuntajätehuollon järjestäminen sosiaali- ja terveydenhuollon sekä pelastustoimen uudistuksen yhteydessä
Kunnan on järjestettävä hyvinvointialueesta annetussa laissa (611/2021) tarkoitetun hyvinvointialueen ja hyvinvointiyhtymän hallinto- ja palvelutoiminnassa syntyvän yhdyskuntajätteen jätehuolto 31 päivään joulukuuta 2025. Tästä poiketen hyvinvointialue ja hyvinvointiyhtymä saavat järjestää mainitun yhdyskuntajätteen jätehuollon 28 §:n mukaisesti ilmoittamalla siitä kirjallisesti kunnalle vähintään kuusi kuukautta ennen jätehuollon järjestämisen aloittamista.
Mitä tässä laissa ja ympäristönsuojelulaissa säädetään kunnan hallinto- ja palvelutoiminnassa syntyvästä yhdyskuntajätteestä, sovelletaan myös hyvinvointialueen ja hyvinvointiyhtymän hallinto- ja palvelutoiminnassa syntyvään yhdyskuntajätteeseen niin kauan kuin kunta on vastuussa mainitun jätteen jätehuollon järjestämisestä.
145 a §Sidos- ja hankintayksiköitä koskevat erityiset säännökset
Poiketen siitä, mitä julkisista hankinnoista ja käyttöoikeussopimuksista annetun lain 15 §:n 1 momentissa säädetään sidosyksiköihin ja 16 §:n 1 momentissa hankintayksiköihin sovellettavista prosenttiosuuksista ja euromääräisistä rajoituksista, kunnan jätehuollon toimialalla toimiviin sidosyksiköihin ja hankintayksiköihin sovellettava prosenttiosuus on kymmenen eikä niihin sovelleta 500 000 euron rajoitusta.
Muutoin noudatetaan julkisista hankinnoista ja käyttöoikeussopimuksista annettua lakia.
