Laki metsästyslain 41 §:n muuttamisesta

Eduskunnan päätöksen mukaisesti muutetaan metsästyslain (615/1993) 41 §:n 1 ja 5 momentti, sellaisina kuin ne ovat laissa 206/2013, seuraavasti:

41 §Poikkeusluvat

Suomen riistakeskus voi myöntää luvan poiketa 37 ja 38 §:n sekä 50 §:n 2 momentin mukaisesta rauhoituksesta, kiellosta tai rajoituksesta 41 a–41 c §:ssä säädetyin edellytyksin. Lupaharkinnassa voidaan ottaa huomioon riistaeläinlajeja ja niiden elinympäristöjen hoitoa koskevat hoitosuunnitelmat, joiden toimenpiteillä otetaan huomioon luontotyyppien sekä luonnonvaraisen eläimistön ja kasviston suojelusta annetun neuvoston direktiivin 92/43/ETY (luontodirektiivi) 2 artikla.

Poikkeuslupien ja 41 a §:n 4 momentissa tarkoitetun alueellisen kiintiön nojalla pyydettävän saaliin vuotuista määrää voidaan rajoittaa. Maa- ja metsätalousministeriön asetuksella voidaan antaa tarkempia säännöksiä siitä, mitä riistaeläinlajia tai poikkeusluvan myöntämisperustetta rajoitus koskee, suurimmasta sallitusta saalismäärästä, saalisyksilöiden sukupuolesta ja iästä sekä alueesta, jota rajoitus koskee. Lisäksi maa- ja metsätalousministeriön asetuksella voidaan antaa tarkempia säännöksiä 41 a §:n 3 momentissa tarkoitetun poikkeusluvan päämäärästä ja alueesta, jota päämäärä koskee, sekä poikkeuksen kohteena olevan lajin suotuisan suojelutason viitearvosta.

Suurpetotyöryhmän toimikausi oli 1.4.2024–15.10.2024. Toimikautta jatketiin 11.10.2024 ministeriön päätöksellä 30.11.2024 asti. Suurpetotyöryhmän loppuraportti julkaistiin 28.11.2024. Esityksen tavoitteena on toimeenpanna suurpetotyöryhmän loppuraportissa ehdotettuja toimia sekä muita toimia ja siten luoda edellytyksiä niin sanotun suurpetojen kannanhoidollisen metsästyksen mahdollistamiseksi. Laki on tarkoitettu tulemaan voimaan mahdollisimman pian, kuitenkin viimeistään 29.5.2025.
