Laki opintotukilain muuttamisesta

Eduskunnan päätöksen mukaisesti lisätään opintotukilain (65/1994) 17 a §:ään, sellaisena kuin se on laissa 960/2017, uusi 2 momentti sekä lakiin siitä lailla 345/2004 kumotun 18 §:n tilalle uusi 18 § ja uusi 27 b § seuraavasti:

17 a §Opiskelijan omien tulojen tulorajojen tarkistaminen

Poiketen siitä, mitä 1 momentissa säädetään, 17 §:ssä säädettyjä tulorajoja sekä 27 §:n 4 momentissa säädettyjä euromääriä ei tarkisteta yleisen ansiotasoindeksin muutoksen mukaisesti vuonna 2022, vaan vuoden 2021 kolmannen vuosineljänneksen loppuun mennessä toteutunutta kahden vuoden ajanjaksona tapahtunutta muutosta vastaava 1 momentissa tarkoitettu ansiotasoindeksiin perustuva tarkistus tehdään vasta 1 päivästä tammikuuta 2023.

18 §Opiskelijan omien tulojen vaikutus opintorahaan ja asumislisään vuonna 2022

Poiketen siitä, mitä 17 §:n 1 momentissa säädetään vapaan tulon laskemisesta, vuonna 2022 opiskelijan vapaa tulo lasketaan siten, että opiskelijalla voi olla tuloa:

1) 870 euroa jokaista kuukautta kohden, jolta hän on saanut opintorahaa tai asumislisää; sekä

2) 2 600 euroa jokaista kuukautta kohden, jolta hän ei ole saanut opintorahaa tai asumislisää.

27 b §Vuoden 2022 vapaan tulon ylitykseen liittyvä takaisinperintä

Poiketen siitä, mitä 27 §:n 4 momentissa säädetään takaisinperinnässä huomioitavista euromääristä, jos opiskelijan 18 §:ssä tarkoitettu vuositulo ylittää vuoden 2022 vapaan tulon, ylityksen jokaista alkavaa 1 730 euroa kohden peritään takaisin yhden tukikuukauden opintoraha ja asumislisä aikajärjestyksessä alkaen kalenterivuoden viimeisestä tukikuukaudesta. Jos vapaan tulon ylitys on ollut enintään 290 euroa, liikaa maksettua tukea ei kuitenkaan peritä takaisin.

§

Tämä laki tulee voimaan päivänä kuuta 20 .

Tämän lain 18 ja 27 b §:ää sovelletaan vuodelle 2022 myönnettyyn opintotukeen.
