Clarifying employment versus self-employment
Acts amending chapter 1, section 1 of the Employment Contracts Act and chapter 13, section 15 of the Seafarers' Employment Contracts Act
A rule on overall assessment will be added to the Employment Contracts Act for situations where it is unclear whether an individual is working under an employment relationship or as an entrepreneur. The amendment will make it easier to identify the correct form of work and prevent employment relationships from being disguised as commission assignments.

What is proposed
The scope provision of the Employment Contracts Act will be clarified so that in ambiguous situations, the nature of the working relationship is assessed through an overall assessment. Instead of relying solely on the contract title, the assessment will take into account the terms of performing the work, the circumstances, the intention of the parties, and other factors affecting the actual independence or subordination of the person performing the work. At the same time, provisions concerning the posting of the act, which had previously been omitted due to a technical error, will be restored to the Seafarers' Employment Contracts Act.
What it means
The amendment will clarify the legal situation, particularly regarding agreements between platform workers, light entrepreneurs, freelancers and their contractors. It will provide authorities and courts with clearer tools to assess employment status and help businesses avoid retroactive adjustments to employment conditions, pension insurance and taxes. The amendment to the Employment Contracts Act will enter into force on 1 July 2023.

Key points of the debate
The debate addressed clarifying the Employment Contracts Act so that the boundary between employment and self-employment is clarified through an overall assessment to prevent bogus self-employment and the disguise of employment relationships. The government parties supported the proposal as a step towards protecting workers in a weaker position. The opposition expressed doubts about the effectiveness of the act and called for either waiting for EU-level regulation or a broader reform of social security and forms of work.
- Will the proposed overall assessment clarify the legal situation, or should Finland wait for the EU platform work directive?
- Do current and proposed legislation take sufficient account of situations combining paid employment and self-employment?
- Social DemocratsIn favour
The Social Democrats (SDP) support the proposal, as it gives authorities clear tools to distinguish employment from self-employment and prevents people from unintentionally falling into bogus self-employment.
”Kokonaisharkintaa koskevan säännöksen lisäämisellä on tarkoitus tarjota apuvälineitä työsuhteen ja yrittäjänä tehtävän työn erottamiseen epäselvissä ja tulkinnanvaraisissa tilanteissa.”
— Tuula Haatainen - Centre PartyIn favour
The Centre Party (Cen) considers the legislative proposal a good means of tackling bogus self-employment and ensuring fair competitive conditions for honest entrepreneurs.
”Mielestäni tämä lainsäädäntöehdotus on hyvä.”
— Anne Kalmari - Left AllianceIn favour
The Left Alliance (Left) supports the act as an important step towards improving worker protection and eradicating bogus self-employment, although it hopes for even stronger measures in future.
”Hyvä, että jatkuvasti meillä Suomessakin otetaan työlainsäädännön askeleita niin sanotusti suojaavampaan suuntaan eli heikommassa asemassa olevan työntekijän suuntaan.”
— Jari Myllykoski - National Coalition PartyIn favour with reservations
The National Coalition Party (NCP) considers drawing the line difficult and notes that, alongside monitoring employment conditions, the new work and earning opportunities created by platform work must be preserved.
”Tässä asiassa on kyse hankalasta kokonaisuudesta.”
— Arto Satonen - Finns PartyAgainst
The Finns Party (Finns) considers that the proposal neither clarifies legislation nor resolves problems, and advocates rejecting the legislative proposal or waiting for the completion of the EU platform work directive.
”Suurimmassa osassa lausuntopalautteista arvioitiin, ettei ehdotus selkeyttäisi nykytilaa tai toteuttaisi hallitusohjelman tavoitteita.”
— Rami Lehto - Christian DemocratsIn favour with reservations
The Christian Democrats (CD) consider preventing bogus self-employment important, but believe the act overlooks contemporary diverse situations where different forms of work are combined.
— Sari Essayah
