Laki tartuntatautilain väliaikaisesta muuttamisesta
Eduskunnan päätöksen mukaisesti lisätään tartuntatautilakiin (1227/2016) väliaikaisesti uusi 48 a § seuraavasti:
48 a §Sosiaali- ja terveydenhuollon asiakkaiden ja potilaiden suojaaminen covid-19-taudilta
Sosiaali- ja terveydenhuollon palveluissa kaikissa tehtävissä, joihin liittyy lähikontaktin aiheuttama tartuntariski covid-19-taudin vakaville seuraamuksille alttiille asiakkaille tai potilaille, saa käyttää vain erityisestä syystä henkilöä, joka ei ole osoittanut, että hänellä on rokotuksen tai enintään kuusi kuukautta aikaisemmin sairastetun laboratoriovarmistetun taudin antama suoja covid-19-tautia vastaan. Työntekijä, joka ei lääketieteellisistä syistä voi ottaa rokotetta, voi osoittaa suojan covid-19-tautia vastaan todistuksella hänelle enintään 72 tuntia ennen työvuoroon saapumista tehdyn covid-19-testin negatiivisesta tuloksesta.
Työnantajalla on oikeus käsitellä sellaisia työntekijän tai työharjoittelussa olevan opiskelijan terveystietoja, jotka koskevat tämän soveltuvuutta 1 momentissa tarkoitettuihin tehtäviin. Tietojen käsittelyssä noudatetaan yksityisyyden suojasta työelämässä annetun lain 5 §:n 2 momenttia. Työnantajan on säilytettävä hallussaan olevat työntekijän terveydentilaa koskevat tiedot erillään muista keräämistään henkilötiedoista. Työnantajan on säilytettävä tiedot niin kauan kuin ne ovat tarpeen sosiaali- ja terveydenhuollon palveluja koskevan valvonnan toteuttamiseksi, kuitenkin enintään kolme vuotta siitä, kun 1 momentissa tarkoitettu henkilön soveltuvuutta koskeva arviointi on tehty.
Jos työntekijä ei täytä 1 momentissa säädettyjä edellytyksiä, työnantajan on ensisijaisesti tarjottava työntekijälle muuta työsopimuksen mukaista työtä tai jos tällaista ei ole tarjolla, muuta työntekijälle sopivaa työtä. Jos tällaistakaan työtä ei ole tarjolla tai työntekijä ei suostu sitä vastaanottamaan, työnantajalla ei ole palkanmaksuvelvollisuutta työnteon estymisen ajalta, ellei toisin ole sovittu.

Tämä laki tulee voimaan päivänä kuuta 20 ja on voimassa 31 päivään joulukuuta 2022. Sen 1 ja 3 momenttia sovelletaan kuitenkin vasta 30 päivän kuluttua lain voimaantulosta.
