What is proposed

The 2016 restrictions on legal aid and appeal periods for asylum seekers will be repealed. The use of publicly funded legal counsel at the asylum interview will be permitted without requiring particularly weighty reasons, appeal periods to the administrative court (previously 21 days) and the Supreme Administrative Court (previously 14 days) will be standardised to the general 30 days, and the fixed case fee for counsel will be replaced by hourly remuneration.

What it means

The change will strengthen legal protection for asylum seekers and increase the willingness of qualified private lawyers to handle asylum cases. The reform will increase the workload of public legal aid attorneys and courts, which is why an additional annual appropriation of 1.1–1.3 million euros will be allocated to legal aid for additional staffing at legal aid offices and for counsel fees. The lengthening of appeal periods may also increase the costs of reception services if the overall processing time for applications increases. The changes will enter into force immediately after the approval of the acts.

Key points of the debate

The debate concerned restoring legal aid and appeal periods for asylum seekers to the level prior to the 2016 legislative amendments. The government parties and the National Coalition Party considered the reform necessary for the legal protection of applicants and the smooth operation of official processes. The Finns Party opposed the proposal, citing additional costs to public finances and the overburdening of legal aid offices.

  • Does the presence of legal counsel at the asylum interview improve processing quality and legal protection?
  • Will the proposed changes excessively increase public expenditure and the workload at legal aid offices?
  • Was it appropriate to repeal the 2016 legal aid amendments?
  • The presence of a lawyer at interviews prevents interpretation and procedural errors that can lead to incorrect decisions and difficult personal situations.

”Nyt kun mahdollistetaan se, että tämmöinen henkilö saisi juristin apua vielä laajemmin, niin se toivottavasti mahdollistaa sitten sen, että meidän oikeusvarmuus tässä kokonaisuudessa paranisi.”
    — Hussein al-Taee
  • GreensIn favour

High-quality legal aid right from the start of the process protects human rights, guarantees fair decisions, and saves public authorities' resources.

”Turvapaikkamenettelyssä nimenomaan alkuvaiheen hyvä laatu varmistaa hakijoille oikeudenmukaisen ratkaisun ja asianmukaisen käsittelyn sekä säästää viranomaisten voimavaroja.”
    — Saara Hyrkkö
  • Left AllianceIn favour

Weakened legal protection is remedied by restoring the right to counsel and adequate appeal periods for applicants in vulnerable positions.

”Yksilön oikeusturvasta huolehtiminen on oikeusvaltion peruspilari.”
    — Veronika Honkasalo
  • The proposal corrects failed legislative amendments and strengthens the rule of law by guaranteeing competent counsel at the most crucial stage of the asylum process.

”Asiantuntevan avustajan mukanaolo turvapaikkapuhuttelussa on erityisen tärkeää, sillä se on asian selvittämisen ja ratkaisun kannalta menettelyn keskeisin vaihe.”
    — Anna-Maja Henriksson
  • The 2016 legislative amendments did not achieve the desired goals of shortening processing times, making their repeal and correction justified.

”Näin ollen itse suhtaudun myönteisesti siihen, että nyt tällä hallituksen esityksellä käytännössä perutaan ne muutokset, jotka tuolloin tehtiin.”
    — Ben Zyskowicz
  • The proposal increases public expenditure, prolongs processes, and diverts the limited resources of legal aid offices away from handling the legal matters of Finns.

”Perussuomalaisten näkökulmasta suomalaisilta kerättyjä verovaroja tulisi käyttää suomalaisten palveluihin ja hyvinvointiin.”
    — Jenna Simula

Main content of the bill (official)
Esityksessä ehdotetaan säädettäväksi lait ulkomaalaislain 9 §:n 2 momentin, 190 §:n 3 momentin, 196 §:n 3 momentin ja oikeusapulain 17 a §:n kumoamisesta. Esityksen tarkoituksena on vahvistaa turvapaikanhakijoiden oikeusturvaa pääministeri Sanna Marinin hallituksen hallitusohjelman mukaisesti.
